감염병예방법에 의하면 감염병을 막기 위해 지방자치단체장은 “여러 사람의 집합을 제한하거나 금지”하는 조치를 할 수 있도록 규정되어 있다. 법 규정에 따른 지방자치단체의 감염병에 대한 대응하는 조치의 정도가 다르게 나타났다. 어느 자치단체장은 집합금지명령을, 다른 자치단체장은 집합제한명령을, 또 다른 자치단체장은 경고에 그치고 있다. 이러한 결과는 현행 우리 감염병예방법이 집합제한 및 금지 규정에 있어 상세하게 대상에 대한 열거나, 감염병 예방에 대한 단계적 조치가 없기 때문이다. 또한 이 법에는 벌금이라는 형사벌을 부과하고 있기 때문에 규정의 명확함이 더욱 요구되는데, 그렇지 못해 문제이다. 근본적으로는 집합이라는 매우 넓은 범위를 지칭하는 용어를 사용하여, 과연 이 범주에 예배가 포함되는지도 불분명하다. 제한과 금지의 대상에 대한 구별이나 명령발동의 조건 등이 법규정에 언급이 없어 법치국가가 요구하는 명확성과 비례성을 위반하는 위헌의 소지가 존재한다. 우리 감염병예방법의 집합금지 규정을 교회예배에 적용하는 것은 비례의 원칙에도 반하는 것이다. 피해에 대한 최소성이 유지되도록 행정명령을 내려야 하는데, 일부 지방자치단체의 장은 중대하고 급박한 위험이 존재하지 않은 상황에 집합금지 행정명령을 내린 경우가 많아, 비례원칙에 합치하지 않는다. 신천지 이단세력에 의한 감염병 방역방해나 위법적 행위에 대해서는 정부나 지방자치단체가 집합금지를 내릴 중대하고 급박한 위험이 존재하지만, 일반적인 교회의 예배를 이와 같은 동질의 것으로 볼 수 없고, 집합제한조치로 충분하다고 본다.

According to the Infectious Disease Prevention Act, the head of local governments is stipulated to take measures to “restrict or prohibit people from gathering” to prevent infectious diseases. The degree of measures taken by local governments to respond to infectious diseases according to the law was different. One local government commander is giving an order to prohibit the group, another commander is giving an order to restrict the group, and another commander is giving a warning. This result is because the current infectious disease prevention method does not stipulate targets in detail in the collection restrictions and prohibitions, but there are no step-by-step measures to prevent infectious diseases. In addition, since this law imposes a criminal penalty called fines, clarity of regulations is required. Fundamentally, it is unclear whether worship is included in this category, using the term ‘people gathering’ to refer to a very wide range. There is a possibility of unconstitutionality that violates the clarity and proportionality required by the rule of law because the legal regulations do not mention the discrimination of the subject of restrictions and prohibitions or the conditions for issuing orders.
