The practice of restorative justice for grassroots water resources protection is deficient. Against this research background, through qualitative and quantitative research methods, field investigations are conducted on typical individual cases. Relevant data on environmental pollution crimes in 90 legal documents are counted and a causal investigation is carried out. The research conclusion is that the limited judicial resources result in difficulties in continuous supervision, a single implementation method and incentive means, and the absence of consideration of social factors under “paper restoration”. At the three levels of implementation, supervision, and society, on the premise of community correction for minor crimes, multiple entities are incorporated to carry out implementation supervision, soft law governance, and evaluation and acceptance work. Social factors are comprehensively considered for interest weighing, and criminal incentives are provided to enterprises or individuals.

基层水资源保护恢复性司法的实践存在阙如,在此研究背景下,通过定性与定量的研究方法,对典型个案进行田野调查,统计90 份文书中污染环境罪的相关数据并开展析因调查,得出司法资源的有限性造成持续监督难、执行方式和激励手段单一和“纸面修复”下社会因素考量缺位的研究结论。在执行、监督和社会三个层面,以轻罪社区矫正为前提吸纳多元主体开展执行监督、软法治理和评估验收工作,综合社会因素进行利益衡量,给予企业或个人刑事激励。
