횡단항법의 적용상 쟁점에 대한 연구 - 영국귀족원 알렉산드라 I 호 판결을 중심으로

A Study on Issues of the Application of the Crossing Rules - Focused on Alexandra I Case decided by UK Supreme Court

선박충돌을 방지하기 위한 항법에서 가장 많이 발생하는 것이 횡단 항법이다. 본 논문에서는 횡단 항법의 적용요건에 대하여 논하였다. 많이 다투어지는것이 정침요건이다. 상대 선박이 일정한 침로를 지켜야 횡단항법을 적용할 수있다는 것이다. 정침이 되지 않았다면 횡단 항법이 적용되지 않게 된다. 이에대해 서로 이견이 있다. 해양안전심판원은 정침요건을 엄격하게 본다. 조금의선수방위변화가 있다면 정침이 되지 않았다고 한다. 그런데, 우리 법원은 요건을 완화하여 항법 적용이 가능하기만 하면 정침 요소를 인정해준다. 그래서 횡단 항법이 적용되게 된다. 최근 영국 대법원의 판결에서도 이와 같은 판결이 나왔다. 좁은 수로에 진입할 때 상대선이 수로의 항로를 따른다면 횡단항법이 적용되지 않는다는 주장이 제기되었지만, 영국 대법원은 입항선이 항로에 진입할때까지는 횡단항법이 적용된다고 판시했다. 우리 법과 다르지않다.

The crossing situation is the most frequently applied rule to avoid collision. In order to apply the crossing rule, several requirements should be met. Among them, there is the on-course requirement. Different views appears on the concept of the on-course. Korea Maritime Safety Tribunal is very strict and thus the on-course requirement has not been admitted easily. As a result. the crossing rule has not been applied. However, courts shows more relaxed position and thus it has been easily admitted. As a result, the crossing rule has been applied. In the Alexandra I case, the English Supreme court followed the latter position. The author agree with the court's decision. Crossing rule is still applicable between entering vessel and the vessel following the fairway in the narrow channel. The entering vessel argued that the crossing rule is no longer applicable because the opposing vessel was on sailing along the fairway. However, the UK Supreme Court ruled that the crossing rule is still applicable until the approaching vessel reaches the enterance of the narrow channel. The decision is not different from the practice and academics's opinion.
