In the context of deepening judicial reform, the reform of the procuratorial organs of “the unity of arrest and prosecution” has become one of the important links. There is a theoretical controversy about the theory of affirmation and negation of the “unity of arrest and prosecution” reform. The reform of the “arrest and prosecution integration” system has three models in practice: the “same person in charge of the same case handling department” model, the “three in one, two diversion” model, and the “who handles the case, who decides, who is responsible” model. The relationship between arrest and prosecution can be regarded as a “relational organization”, and it is necessary to examine this “organization” from the perspective of organizational sociology and reveal its problems. Specifically, it is reflected in the rationality of organizational processes and the implementation of the principle of due process of “combining arrest and prosecution”; The purpose of organization goals and the protection of suspect 'rights in the “integration of arrest and prosecution”; The principle of organizational conflict resolution and the issue of supervision and restraint in the integration of arrest and prosecution; The theory of organizational change and development, the integration of arrest and prosecution, and the issue of career development for prosecutors. From the perspective of organizational sociology, the basic structure of “combining arrest and prosecution” should be clarified and optimized. The principle of organizational cooperation provides an analytical path for the consensus of cooperation in the reform of the “integration of arrest and prosecution” system; The principle of organizational structure provides innovative organizational methods for the reform of the “integration of arrest and prosecution” system; The theory of organizational action provides a basis for institutional construction in the reform of the “integration of arrest and prosecution” system.

在深化司法改革背景下,“捕诉合一”制度改革成为检察机关改革的重要课题之一。目前,理论界对“捕诉合一”制度改革存在争议,即肯定说和否定说。“捕诉合一”制度改革在实践中存在“同一办案部门的同一承办人办理”模式、“三合一,两分流”模式、“谁办案,谁决定,谁负责”三种模式。捕诉关系可以被视为一个“关系组织”,对该“组织”有必要进行组织社会学视角的审视并揭示其问题。这些问题具体体现为:组织过程的合理性与“捕诉合一”正当程序原则的贯彻问题;组织目标的合目的性与“捕诉合一”中犯罪嫌疑人权利保障问题;组织冲突解决原理与“捕诉合一”的监督制约问题;组织变迁发展理论与“捕诉合一”与检察官职业发展问题。在组织社会学视角下,应当明确“捕诉合一”的基本结构并进行优化。组织合作原理为“捕诉合一”制度改革提供了合作共识的分析路径;组织结构原理为“捕诉合一”制度改革提供了创新组织方法;组织行动理论为“捕诉合一”制度改革提供了制度建设依据。
