网络虚拟财产的继承问题研究

Research on the Inheritance of Virtual Property in Cyberspace

With the increasing number of network virtual assets, its inheritance has become more and more important. This article aims to explore the inheritance of network virtual property, including the definition, classification and characteristics of network virtual property, as well as the provisions and existing problems of current laws on network virtual property inheritance. There are five parts in this article. The first part is the introduction, which mainly includes research background, research significance, etc. The second part is the theoretical dispute over the property rights of the network virtual property, aiming to pave the way for the future. The third part is the inheritance analysis of network virtual property. The fourth part focuses on the analysis of the practical dilemma faced by the inheritance of network virtual property in China. The fifth part provides specific ideas for improving China’s online virtual property inheritance system. This paper deeply studies the problem of network virtual property inheritance. On the basis of analyzing the current situation, it puts forward a series of feasible solutions to promote the improve.

网络虚拟财产的是以数字化形式存在于网络空间中，具有使用价值和交换价值的财产性利益。随着信息时代的到来，互联网的快速发展，网络虚拟财产的数量也在不断增加，如何解决好其继承问题迫在眉睫。本文通过文献分析、比较分析、案例分析等方法，旨在探讨网络虚拟财产继承问题，包括网络虚拟财产的定义、分类和特点，以及现行法律对网络虚拟财产继承的规定和存在的问题。首先，明确网络虚拟财产的定义，着重分析了网络虚拟财产存在的理论纠纷，主要包括物权说、债权说等，引出本文支持在权利属性上采用物权说可以全面地保护网络虚拟财产的观点。其次，对网络虚拟财产继承的可能性进行分析论证，目的是为后文做好理论铺垫。之后，通过实践研究，列举我国网络虚拟财产继承所面临的现实困境，最后，对如何进一步完善我国网络虚拟财产继承提出了一些具体的设想，本文深入研究了网络虚拟财产继承问题，在分析现状的基础上，提出了一系列可行的解决方案，以期在法律和实践层面促进网络虚拟财产继承制度的完善。
