학교폭력 가해자의 진술수법에 관한 연구 - 중화기술을 활용한 지속적 위증사례를 중심으로

A Study on the statement techniques of school violence prepetrators : Focusing on cases of continuous false testimony using neutralization techniques

본 연구는 최근에 발생한 학폭위 실제사례를 선정하여 전개과정을 연구대상으로 삼았다. 법리적으로 검토된 공적서류 및 일 부면담조사를 기반으로 실제 표출된 가해자의 중화기술을 탐색하여 확인된 결과를 토대로 유형별로 정리하였다. 가해자는 중화 기술(책임부인, 비난자부정, 상위충성심에 호소, 피해자부인, 피해부인) 5가지 전략을 모두 사용된 것으로 탐색되었으며, 책임부 인-‘강’, 비난자부정-‘중’, 상위충성심에 호소-‘강중’, 피해자부인-‘강중’, 피해부인-‘강중’으로 분석되었다. 가해자는 지속적으 로 중화기술을 통해 피해자와 목격자를 학폭심의위원회에 회부시켰다. ‘조치결정 없음’으로 사안처리가 확정되었음에도 불구하 고 지속적으로 허위사실을 은폐하기 위하여 학폭신고 이슈를 형사고소에 활용하는 계획적인 치밀함도 관찰되었다. 따라서 각급 학교에 설치된 전담기구의 역할과 공정성을 충분히 소화할 수 있도록 다양한 전문가를 구성, 중화기술을 이해하고 필터링 할 수 있는 매뉴얼 개발 및 실무교육의 필요성을 제시해 본다. 무엇보다 학폭전담기구의 관심과 적극적인 개입·해결의지가 매우 중요 하다.

This study selected a recent actual case of school violence and studied its development process. Based on legally reviewed public documents and some interview investigations, the actual neutralization techniques of the perpetrator were explored and organized by type based on the confirmed results. The perpetrator was found to have used all five neutralization strategies (denial of responsibility, condemnation of condemners, appeal to higher loyalties, denial of the victim, denial of injury), and was analyzed as denial of responsibility - 'strong', condemnation of condemners - 'moderate', appeal to higher loyalties - 'strong-moderate', denial of the victim - 'strong-moderate', denial of injury-'strong-moderate'. The perpetrator continuously referred the victim and witnesses to the school violence deliberation committee through neutralization techniques. Even though the case was finalized as 'no action decision', the systematic meticulousness of continuously using the issue of school violence reports in criminal complaints to conceal false facts was also observed. Therefore, it is suggested to form a diverse group of experts to fully take on the roles and fairness of the dedicated organizations installed in each school, and to develop manuals for understanding and filtering intermediate techniques, along with the need for practical training. Above all, the attention and active involvement and determination to resolve issues by the school violence dedicated organizations are of utmost importance.
