의료 마이데이터에서 기본권 침해의 헌법적 검토

최근 의료정보의 접근 방식이 기술과 데이터의 결합으로 빠르게 변하고 있다. 이러한 변화는 보건의료의 목적인 건강 보호 및 증진, 질병 치료를 위한 접근 방식이 기술과 데이터의 결합으로 인하여 원하는 의료서비스에 정보를 제공하거나 활용할 수 있는 것을 의미한다. 특히 의료데이터의 공유와 활용이 중요해지면서 의료정보의 권한이 정보주체인 개인에게 있음을 강조하는 의료 마이데이터 산업이 데이터 활용의 새로운 패러다임으로 대두되고 있다. 이처럼 의료 마이데이터는 의료정보의 활용도를 높이는 한편, 개인의 의료정보에 대한 정보주체의 권리를 강화하는 수단으로 주목받고 있다. 최근 의료법이 개정되면서 진료기록을 이전받거나 제3의 의료기관에 직접 전송을 요청할 수 있게 되었다. 이러한 측면에서 의료 마이데이터는 앞으로 비약적인 발전을 할 것으로 기대를 모으고 있는데, 그에 비하면 의료 마이데이터 도입에 따른 법적 검토는 아직 부족한 상황이다. 그동안 개인정보를 수집한 기업들은 자신들의 플랫폼을 통해 데이터 수익을 창출해 왔는데, 의료 마이데이터의 도입이라는 법적 불확실성에 놓여 있다. 이러한 맥락에서 본 논문은 의료 마이데이터 산업의 지속적이고 안정적인 성장을 위해서 기본권 보장 문제, 이익 배분의 문제, 다른 법령과의 충돌에 따른 법적 검토를 하였다. 또한 의료 마이데이터에서 데이터 시대의 환경에 부합하는 기본권 보장의 실현 방안을 시사점으로 제시하였다.

Recently, the approach to medical information is rapidly changing through the combination of technology and data. This change means that the purpose of healthcare, which is to protect and promote health and treat diseases, can provide or utilize information for desired medical services through the combination of technology and data. In particular, as the sharing and utilization of medical data become more important, the medical MyData industry, which emphasizes that the authority over medical information lies with the individual as the information subject, is emerging as a new paradigm for data utilization. In this way, medical MyData is attracting attention as a means to increase the utilization of medical information while strengthening the rights of the information subject to personal medical information. Recently, with the revision of the Medical Act, it has become possible to transfer medical records or request direct transmission to a third-party medical institution. In this respect, medical MyData is expected to make great strides in the future, but compared to this, legal review of the introduction of medical MyData is still insufficient. As a result, companies that have collected personal information have been generating data revenue through their own platforms, but are facing legal uncertainty regarding the introduction of medical MyData. In this context, this paper conducted a legal review of the issues of guaranteeing basic rights, profit distribution, and conflicts with other laws for the sustainable and stable growth of the medical MyData industry. In addition, it suggested a way to realize guaranteeing basic rights in accordance with the environment of the data era in medical MyData.
