정책형성 관점에서의 미국 주의회 입법 과정과 제도 연구

A Study on the Legislative Process and Systems of U.S. State Legislatures from the Policy Formation Perspective

이 연구는 정책형성의 관점에서 미국 주(州)의회의 입법과정 관련 제도와 입법사례의 분석을 통해 정책적･실천적 함의를 탐색해 보고자 하는 것이 연구의 목적이다. 정책형성과정에서 정책실패가 야기되는 원인은 다양하지만 그러한 정책실패를 줄이기 위한 전략으로 정책형성과정(입법과정)과 관련한 보다 나은 제도와 지원 체계의 설계와 운영은 하나의 대안이 될 것이다라는 관점에서 미국 주의회의 전반적인 구조와 제도를 개략적으로 살펴본 후 구체적 사례로서 텍사스 주의회 하원을 중심으로 입법 관련 절차와 제도를 검토하고, 구체적인 입법(정책)사례도 함께 분석해 봄으로써 제도의 실제 운영적인 내용도 검토해 보았다. 정책형성과정에서의 정책실패를 줄이기 위한 제도의 설계와 관리의 관점에서 주요 내용과 시사점을 요약하면 다음과 같다. 첫째, 의안(법률안 또는 조례안)의 심의 과정에서의 수정 사항을 반영한 법안분석과 함께 특정 분야에 해당되는 의안의 비용추계나 입법영향평가도 이루어질 수 있도록 하는 제도 설계를 고려해 볼 수 있다. 둘째, 상임위원회에서 통과되어 본회의에 보고되는 의안을 내용, 중요성, 영향력 등을 기준으로 광범위하고 논란의 여지가 있는 의안과 좁고 논란의 여지가 없는 의안 등으로 구분하는 의안목록시스템(calendars system)의 설계도 고려해 볼 수 있다. 이러한 제도의 설계와 운영에 있어 선행되어야 하는 것은 전문적인 입법 지원조직의 구축과 정책 지원인력의 보강이 될 것이다.

The purpose of this study is to explore policy and practical implications by analyzing the systems and policy cases related to the legislative process of the U.S. state legislature from the perspective of policy formation. The causes of policy failures in the policy formation process are diverse, but designing better management of processes and systems related to the policy formation process (legislative process) would be an alternative strategy to reduce such policy failures. From this perspective, I briefly reviewed the overall structure and institutions of U.S. state legislatures. As a case study, I analyzed the legislative procedures and systems as well as specific legislative cases focused on the Texas House of Representatives. The main policy implications from the perspective of designing and managing the system to reduce policy failures in the policy formation process are as follows: First, it is necessary to consider designing a system that allows for continuous bill analysis that reflect amendments made during the deliberation process, as well as cost estimation and legislative impact assessment for bills in specific fields. Second, it would be worth considering designing a calendars system that divides bills submitted to the plenary session into broad and controversial bills and narrow and non-controversial bills based on content, importance, and influence. In order to design and operate such systems, securing a professional support institution and personnel would be prioritized.
