중소기업의 특허에 대한 외국인 투자자 반응: 의료용 물질 및 의약품제조업(C21)을 중심으로

Foreign Investor Response to Patents of Small and Medium-sized Enterprises: Focusing on Manufacture of Pharmaceuticals, Medicinal Chemical and Botanical Products (C21)

중소기업의 원활한 자금 조달을 위해 외국인 투자 유치에 대한 관심이 증대되고 있으나, 외국인 투자자는 국내 중소기업에 대한 정보비대칭 문제로 인해 중소기업의 존재 자체를 인지하기 어렵거나 정보가 부족하여 고위험의 투자대상이라고 인식하는 경향이 있다. 그러나 중소기업이 우량 스타특허를 보유한 경우, 해당 중소기업의 인지도가 제고되고 정보비대칭 문제가 완화되며 특허의 독점적 권리를 통해 미래의 잠재적 이익을 기대함에 따라 외국인 투자자에 의해 선호될 수 있다. 이러한 관점에 기반하여, 본 연구는 의료용 물질 및 의약품 제조업(C21)을 영위하는 중소기업을 대상으로 중소기업이 보유한 특허에 대한 외국인 투자자의 반응을 실증적으로 분석하였다. 특허의 특성을 나타내는 변수로는 특허의 수와 특허의 법적인 권리의 범위를 설명하는 청구항 수, 기술적·경제적 가치를 나타내는 피인용 빈도를 독립변수로 사용하였다. 특히 기업이 보유하는 스타특허의 질적 특성을 분석하기 위해 기업별 최대 청구항 수와 최대 피인용 빈도를 변수로 설정하였다. 분석 결과 중소기업이 보유한 특허의 최대 청구항 수와 최대 피인용 빈도가 많을수록, 외국인 투자 비율이 유의하게 증가하는 것으로 나타났다. 이는 우량한 스타특허를 보유한 중소기업에 대한 인지도 제고 및 특허 정보를 통한 정보비대칭 문제 감소, 특허를 통한 성장 기대감이 증대됨에 따라, 외국인 투자자가 해당 중소기업에 투자하는 경향이 있음을 제시한다. 본 연구는 스타특허를 보유한 중소기업에 대한 외국인 투자자의 반응을 검증한 최초의 연구로서, 중소기업의 우량특허 보유가 해외자본조달에 기여할 수 있음을 시사한다.

Interest in attracting foreign investment is increasing to facilitate the smooth financing of small and medium-sized enterprises. However, due to information asymmetry issues regarding domestic SMEs, foreign investors have difficulty recognizing the existence of SMEs or tend to perceive them as high-risk investment targets due to insufficient information. However, if SMEs possess excellent star patents, their recognition will be enhanced, information asymmetry problems will be alleviated, and they may be preferred by foreign investors because they expect future potential profits through the exclusive rights of the patent. Based on this perspective, this study empirically analyzed the responses of foreign investors to patents held by SMEs engaged in Manufacture of pharmaceuticals, medicinal chemical and botanical products(C21). The variables representing the characteristics of patents were the number of patents, the number of claims meaning the range of the legal rights of the patent, and the frequency of citations reflecting the technical and economic value as independent variables. In particular, in order to analyze the qualitative characteristics of star patents held by companies, the maximum number of claims and the maximum citation frequency were set as variables for each company. The analysis results showed that the higher the maximum number of claims and the maximum citation frequency of patents held by SMEs, the higher the foreign investment ratio significantly. This suggests that foreign investors tend to prefer investing in SMEs with excellent star patents, as awareness of them increases, information asymmetry problems are reduced through patent information, and growth expectations through patents increase. This study is the first to analyze the reactions of foreign investors to SMEs holding star patents, suggesting that SMEs holding excellent patents can contribute to foreign capital procurement.
