인터넷 기술의 빠른 발전에 따라 인터넷 방송은 새로운 산업 형태로 급격히 성장하였고, 많은 종사자를 끌어들였다. 그러나 인터넷 방송인이라는 이 새로운 직업군의 노동 권리 보호는 많은 도전에 직면해 있다. 본 연구는 인터넷 방송인의 노동권리 보호 문제를 심층적으로 탐구하는 것을 목표로 한다. 우선, 인터넷 방송인의 노동 관계의 특수성을 분석한다. 여기에는 업무 성격의 유연성, 수입 모델의 불확실성, 노동 관계의 모호성 등이 포함된다. 이 글은 인터넷 방송인들이 노동 권리 보호 측면에서 겪고 있는 주요 문제를 드러낸다. 예를 들어, 공식적인 노동 계약의 부재, 불안정한 수입, 과도한 근로 시간, 신체적·정신적 건강의 악화, 그리고 비효율적인 권리 보호 경로 등이 그것이다. 이러한 문제들을 해결하기 위해 본 연구는 여러 가지 개선 방안과 제안을 제시한다. 여기에는 법률 제도의 강화, 인터넷 방송인의 법적 지위 명확화, 사회적 인식 변화 촉진, 플랫폼의 책임 의식 강화, 다양한 분쟁 해결 기구의 구축, 산업자율 규제 강화 등이 포함된다. 이러한 조치들의 시행을 통해, 보다 공정하고 정의로우며 질서 있는 인터넷 방송인의 노동 환경을 구축하고, 방송 진행자의 합법적인 권리를 보장하며, 인터넷 방송 산업의 건강하고 지속 가능한 발전을 촉진하고자 한다. 본 연구는 인터넷 방송인의 노동 권리 보호에 대한 이론적 가치를 제공할 뿐만 아니라, 관련 정책 수립과 실무적 운영에 유익한 참고자료를 제공한다.

With the rapid development of Internet technology, online live streaming has emerged as a new industry, attracting a large number of practitioners However, the protection of labor rights for online streamers, as a new occupational group, faces many challenges. This article aims to delve into the issues of labor protection for online streamers. It first analyzes the peculiarities of the labor relationship for online streamers, including the flexibility of work nature, the uncertainty of income, and the ambiguity of labor relationship. This article reveals the main problems in the labor rights protection for online streamers, such as the lack of formal labor contracts unstable income, excessive working hours, damage to physical and mental health, and poor channels for rights protection. In response to these problems, this article proposes a series improvement measures and suggestions, including strengthening legal system construction, clarifying the legal status of online streamers, promoting changes in social perceptions, enhancing platform responsibility awareness, a diversified dispute resolution mechanism, and strengthening industry self-discipline. Through the implementation of these measures, it aims to build a fairer, more just, and labor environment for online streamers, to protect the legitimate rights and interests of online streamers, and to promote the healthy and sustainable development of the online live streaming. This study not only has theoretical value for the labor rights protection of online streamers, but also provides useful references for related policy-making and practical operations.
