산업입지 규제 관련 법적 쟁점 및 개선 방안 연구

Review of legal issues related to industrial location regulation and research on improvement measures

산업입지 규제는 기업을 운영함에 있어서 생산 및 영업활동을 영위하기 위한 장소적 기초를 설정하고 운영하는 데에 어려움을 야기한다. 그 결과 기업의 물적 생산 기반을 손상시키는 핵심 규제로 작용하는 경우가 많아 합리적 개선의 필요성이 매우 크다. 이에 본 연구는 공장 또는 영업장의 신·증설이나 이전 등 입지 문제와 관련된 산업입지 규제 중 기업에 불필요·불합리한 규제부담을 유발하는 사례를 선별하여 규제비용 감소의 차원에서 쟁점과 개선 방안을 검토하였다. 본 논문의 구체적인 내용은 다음과 같다. 첫째, 공장 및 사업장의 장소적·물리적 기반으로서 산업입지 규제의 특성을 분석하였다. 산업입지 규제는 국토계획 및 개발·환경 분야의 법령 등 다양한 덩어리 규제, 복합적 규제와 밀접한 연관이 있다. 따라서 산업입지 자체에 대한 규제뿐만 아니라 개발행위 및 환경 관련 규제와 얽혀있는 법·제도적 이슈를 발굴하여 분석대상으로 삼음으로써 보다 실제적인 정책적 시사점을 도출하였다. 둘째, 규제부담의 특성 및 규제개선의 편익에 초점을 둔 연구를 수행하였다. 산업입지 관련 규제 분야의 개선은 기본적으로 불필요·불합리하거나 중복된 규제 부담 가중, 투자 저해에 따른 기업 활력 쇠퇴 등의 부작용을 야기하며, 이는 기업의 공장 신·증설에 따른 지역경제 활성화 및 고용 창출, 리쇼어링, 해외투자 유치 등을 저해할 우려를 낳고 있다. 이러한 규제부담의 특성과 규제개선 편익 및 수혜기업의 특성에 초점을 맞추어 본 논문에서는 규제의 구체적 내용이 실제로 기업에 야기하는 규제부담의 내용 및 정도에 대하여 정성적·정량적으로 검토하여 제시하고자 하였다. 이와 같은 규제 현황 및 관련 기업의 규제부담 식별·분석 결과를 토대로 산업입지 규제사안별 쟁점을 논의하고 법제 개선을 통한 규제부담 해소방안을 제시하였다.

Industrial location regulations create difficulties for small and medium-sized venture enterprises in establishing and operating the physical basis for production and sales activities. As a result, it often acts as a key regulation that damages the physical production base of enterprises, and there is a great need for rational improvement. Therefore, this study examines issues and improvement measures to reduce regulatory costs by selecting entry regulations that cause regulatory burdens on SMEs among industrial location regulations related to location issues such as new, expanded, or relocated factories or business sites. The specific contents of this paper are as follows. First, we analysed the characteristics of industrial location regulations as the geographical and physical basis of factories and business sites. Industrial location regulation is closely linked to a variety of mass and complex regulations, such as laws and regulations in the fields of land planning, development, and environment. Therefore, by identifying the legal and institutional issues that are intertwined with development activities and environmental regulations, as well as the regulation of industrial location itself, we have drawn more practical policy implications. Second, the study focused on the nature of regulatory burden and the benefits of regulatory improvement. Improvements in the field of industrial location-related regulations basically cause side effects such as increased burdens due to the entry regulation method and decline in corporate vitality due to hindered investment, which may hinder the revitalisation of the local economy, employment creation, reshoring, and attraction of overseas investment by companies building new or expanding factories. Focusing on the characteristics of these regulatory burdens, the benefits of regulatory improvements, and the characteristics of beneficiary companies, this paper presents a qualitative and quantitative review of the content and extent of regulatory burdens that the specific contents of regulations actually cause to companies. Based on the results of this analysis, the paper identifies and analyses the regulatory burdens of companies by industrial location regulations and suggests ways to resolve regulatory burdens through legislative improvements.
