A system for resolving medical disputes : Focusing on ADR

This paper provides an overview of the ADR system, and introduces the concept, advantages and disadvantages of the ADR system, and each ADR system currently in operation. Next, it introduces the concept related to medical disputes, the requirements for civil and criminal liability in the event of a medical accident, and examines the current status of the systems such as mediation and arbitration operated by the ‘Korea Consumer Agency' and the ‘Korea Medical Dispute Mediation and Arbitration Agency', and then examines cases of meaningful medical disputes handled by each organization. In addition, it introduces the main contents of the “Medical Accident Processing Special Act (draft)” that is currently being legislated. It should become a reasonable bill through sufficient deliberation among each stakeholder in the future. In conclusion, it is necessary to actively promote the use of the ADR system represented by mediation or arbitration.
