A study on the Use of ChatGPT in Commercial Arbitration and the Establishment of Artificial Intelligence-based Arbitration Procedures

With the advent of the 4th industrial revolution, artificial intelligence (AI) technologies, including ChatGPT, are attracting attention as future growth engines. Under these circumstances, companies are actively attempting to innovate their management by introducing AI search and chatbot technology. In the early days of the computer industry, the users of the technology were concentrated on computer engineers. However, as witnessed in the chess match between Lee Sedol and AlphaGo in 2016, high-performance AI technologies have begun to appear in large numbers, and these AI technologies are actively contributing to improving the quality of human life, naturally permeating our daily lives, and being commercialized. Furthermore, AI technology has improved work efficiency in the trade sectors such as contracts, payments, transportation, logistics, finance, and dispute resolution. The introduction of ChatGPT, which has been recognized as having the best performance among chatbot technologies released so far, is also expected to produce significant results. It is clear that ChatGPT, which has already affected various legal fields, will bring changes to arbitration. Therefore, this study aims to present theoretical and practical implications for implementing ChatGPT across the entire arbitration regime. This study confirmed the possibility of using ChatGPT in arbitration by showing that when some existing arbitration awards were input into ChatGPT, it gave answers similar to the awards made by the arbitration tribunal. However, ChatGPT clearly has limitations with its current technology, this study proposes a method for appropriately introducing ChatGPT technology in arbitration procedures, and suggesting a method for building arbitration procedures through harmonization between the arbitration system and ChatGPT. As a method for constructing specific arbitration procedures, we presented details such as administrative assistance for ChatGPT, such as document preparation.
