On the Construction of Legal Thinking of “Artificial Intelligence Arbitrator”

论“人工智能仲裁员”的法律思维构建

With the rapid advancement of artificial intelligence technology,the arbitration field is increasingly adopting intelligent solutions to enhance efficiency and fairness.However,how to simulate the legal thinking of arbitrators in technological applications and ensure the rationality and interpretability of their decisions has become a focal issue.Artificial intelligence can simulate the legal thinking of arbitrators through a refutable multi-dimensional legal reasoning model,which includes6 the selection of conflicting legal norms,evidence reasoning,and legal application.Despite this,intelligent arbitration still faces significant challenges in terms of decision interpretability and data security.To address these issues,it is suggested that emotional computing and the embedding of value consensus be used to improve the normative value concept system of artificial intelligence,thereby enhancing its ability to make value judgments in legal reasoning.Additionally,strengthening data security management to ensure the confidentiality and quality of data is crucial for improving the reliability and fairness of intelligent arbitration.Although artificial intelligence has broad prospects in the arbitration field,the construction and improvement of its legal thinking still require continuous exploration.With appropriate technological applications and institutional safeguards,artificial intelligence is expected to play a greater role in arbitration,providing strong support for achieving more efficient and fair arbitration decisions.

随着人工智能技术的迅猛发展，仲裁领域正逐步引入智能化解决方案，以提高仲裁效率和公正性。然而，如何在技术应用中模拟仲裁员的法律思维并确保其决策的合理性和可解释性，成为当前关注的热点问题。人工智能可以通过构建可辩驳的多元法律推理模式来模拟仲裁员的法律思维，具体包括冲突法律规范的取舍、证据推理和法律适用等环节。尽管如此，智能仲裁在决策的可解释性和数据安全方面仍面临诸多挑战。为此，建议通过情感计算和价值共识嵌入来完善人工智能的规范化价值理念体系，以增强其在法律推理中的价值判断能力。此外，加强数据安全管理，确保数据的保密性和质量，是提高智能仲裁可靠性和公正性的关键。人工智能在仲裁领域的应用具有广阔前景，但其法律思维的构建和完善仍需不断探索。本研究认为通过合理的技术应用和制度保障，人工智能有望在仲裁中发挥更大的作用，为实现更高效、公正的仲裁裁决提供有力支持。
