中国学界关于“五四宪法”若干问题的研究回顾与综述

A Research Review on Several Issues of the “1954 Constitution” in Chinese Academia

“五四宪法”是中国第一部社会主义类型宪法，是中国共产党领导人民探索新中国法治建设的伟大实践，对我国社会主义民主法治建设具有重大奠基意义。作为中国现行宪法的文本基础，“五四宪法”是从事近现代史研究学者关注的重要问题之一，中国学术界七十年来关于“五四宪法”相关研究成果蔚为大观，多集中于《共同纲领》和“五四宪法”的比较、苏联对“五四宪法”的影响、毛泽东与“五四宪法”的关系和“五四宪法”的反思和评价等问题。根据所掌握的材料重点对“五四宪法”的研究状况及代表性观点略做梳理和总结，探究还存在的拓展空间，以站在新的起点上以更加全面、历史、辩证的科学态度评析“五四宪法”。

As the textual basis of China’s current constitution, “1954 Constitution” is one of the important issues concerned by scholars engaged in modern history research. The domestic academic circles have made great achievements in the research of “1954 Constitution” in the past 70 years. According to the mastered materials, the research status and representative views of the “1954 Constitution” are briefly sorted out and summarized, and the remaining space for expansion is explored, so as to stand at a new starting point and evaluate the “1954 Constitution” with a more comprehensive, historical and dialectical scientific attitude.
