Patent Pool as a Preemptive Action Against Patent Trolls

본 연구는 복잡한 기술 소송의 위협 속에서 특허 괴물이 규모와 관계없이 기업을 고소하는 활동을 줄이는데 특허 풀이 긍정적인 역할을 하는지에 대해, 게임 이론과 수직적 차별화 모델을 활용하여 탐색한다. 두 기업이 핵심 기술을 유사한 품질로 개발하면 가격 경쟁이 심화되어 제품 가격이 낮아지지만, 개발된 기술의 격차가 커질수록 제품 가격이 상승하는 것으로 나타난다. 또한, 두 기업 사이 기술의 품질 격차가 커질수록 특정한 지점까지는 두 기업의 이윤이 감소하지만, 그 기준점을 넘어서면 두 기업 모두 이윤이 증가하는 것을 보인다. 특허 괴물은 타겟 회사의 매출과 소송에서의 승산 가능성에 따라 행동하며, 기업은 공격을 받고 패할 확률에 따라 특허를 판매할지 풀링(pooling)할지를 선택한다. 특허 가격이 일정 수준 이상 상승하면, 기업은 선제적으로 풀링하는 것보다 향후 발생할 수 있는 분쟁을 처리하는 것이 더 유리할 수 있다. 본 연구에서는 두 기업의 기술이 적절한 수준에서 중첩되어 경쟁할 때 특허 풀(patent pool) 전략이 부분 게임 완전균형(SPNE)이 되는 영역을 보인다. 그리고, 두 기술의 중첩 수준이 너무 낮으면 특허 괴물이 활동할 여지가 줄어들고, 반대로 너무 크면 기업이 생산에 참여할 인센티브를 잃게 된다. 따라서 기술이 적절한 수준으로 중복될 때, 풀링이 최적의 전략임을 보인다. 마지막으로 사회 후생에 대한 분석 결과, 특허 괴물의 존재가 사회 후생 전반에 긍정적인 영향을 미치지만, 기술 품질이 높은 수준에 도달하면 오히려 부정적인 영향을 미칠 수 있음을 발견한다.

This study explores whether a patent pool plays a positive role in reducing the activity of patent trolls—who sue firms of all sizes amid the threats of complex technology litigation—by using a game theory framework based on a vertical differentiation model. We find that when both firms develop core technologies of similar quality, price competition arises, leading to a decrease in product prices. However, if there is a significant gap in technology quality between the firms, pooling results in higher prices. Additionally, we examine how the difference in quality affects the profits of the two companies. As the quality gap widens, the combined profit of the two firms initially decreases until it reaches a certain cutoff point, beyond which their profits begin to increase. We then identify the region where the pooling strategy becomes a unique Subgame Perfect Nash Equilibrium (SPNE) when the technologies overlap to an appropriate degree. The incentive for pooling is greatest when the technology overlap is moderate, and it decreases as the level of technology overlap increases. Furthermore, we conduct a social welfare analysis and find that while the presence of patent trolls generally has a positive effect on social welfare, it negatively impacts welfare at higher levels of technology quality.
