자연법에 기초한 정체성 정치의 새로운 구상: 문화적 민주주의 발전을 위한 제언

Towards a New Conception of Identity Politics Based on Natural Law: A Suggestion for Development of a Cultural Democracy

본 연구의 목표는 87년 민주화 이후 한국 사회의 민주주의 발전에 기여할 수 있는 정체성 정치를 새롭게 구상하는 것이다. 그 새로운 역할은 소수집단의 정체성을 인정받기 위한 투쟁이 더는 아니다. 이런 투쟁은 시민사회를 양분화시키면서 민주주의를 후퇴시킨다. 정체성은 상징적으로, 곧 문화적 이미지로 구성된다는 점에서, 본 연구는 정체성 정치의 과제를 ‘문화적 민주주의 운동’이라 명명했다. 그것은 일상생활의 내면에서 작동하고 있는 의미와 가치를 공론화함으로써 민주주의를 사회 전반으로 확장시킬 수 있는 문화적 투쟁이다. 더 나아가 서로 각기 다른 주체성을 수용할 수 있는 공동의 가치와 규범을 만들어 내는 실천이다. 이것은 서로 다른 정체성을 뚜렷하게 대비시키며 타자를 배제하는 일상의 악을 넘어서려는 생활정치다. 이러한 정체성 정치의 새로운 과제는 자연법을 비판적으로 검토하여 도출된 윤리 사상에 근거한다. 곧, 인간이성을 강조하는 전통과 본질주의를 벗어나려는 실존적 자연법사상이다. 따라서 새로운 정체성 정치는 인간실존의 관계적 양상과 연대성과 공동선, 의사소통하는 이성에 기반하여 구상되었다.

The aim of this study is to conceive the new identity politics that can contribute to the development of democracy in Korean society after democratization in ’87. The new task is not a struggle to gain recognition of the identity of minority groups anymore. This struggle divides civil society and sets democracy back. Since identity consists of symbols as well as cultural images, this study named the democracy movement of the post-democratization as ‘the cultural democracy movement.’ It is a cultural struggle that can extend democracy to society as a whole by publicizing the meaning and value system that is operating within everyday life. Furthermore, it is a practice that creates common values which can accommodate different identities. This is a kind of life politics to overcome everyday evil that contrasts identities clearly and excludes others. These new tasks of identity politics are based on ethical ideas derived from a critical review of natural law. These are especially based on a tradition that emphasizes human reason and existential natural law that seeks to escape the charge of essentialism. So, the new identity politics is based on a moral basis on the existential relational aspect of human beings, solidarity and communicative reason.
