Criminal Law Regulation of Artificial Intelligence Abuse: Current Status, Challenges, and Prospects

人工智能滥用的刑法规制：现状、挑战与展望

With the rapid development of artificial intelligence (AI) technology, its applications in various fields of society are becoming increasingly widespread. However, the problem of abuse of artificial intelligence is gradually emerging, such as deepfake fraud, AI market manipulation, AI hacker attacks, etc., which pose new challenges to the criminal law system. The current regulation of artificial intelligence abuse in Chinese criminal law still mainly relies on traditional charges, such as fraud, illegal acquisition of computer information system data, and infringement of citizens' personal information. However, there are still many difficulties in determining the criminal subject, applying the elements of the crime, and legal lag. On the basis of analyzing the main forms of artificial intelligence abuse and the current situation of criminal law regulation, this article explores the difficulties in the application of criminal law caused by the abuse of artificial intelligence, and proposes optimization paths for future criminal law in improving the setting of charges, strengthening cross departmental collaborative governance, promoting international cooperation, and using technological means to strengthen supervision, in order to build a more complete criminal law regulation system for the abuse of artificial intelligence and ensure the safe and compliant application of artificial intelligence technology.

随着人工智能（AI）技术的快速发展，其在社会各领域的应用日益广泛。然而，人工智能的滥用问题也逐渐显现，如深度伪造（Deepfake）诈骗、人工智能操纵市场、AI 黑客攻击等，这对刑法体系提出了新的挑战。当前中国刑法对人工智能滥用的规制仍主要依赖传统罪名，如诈骗罪、非法获取计算机信息系统数据罪、侵犯公民个人信息罪等，但在犯罪主体认定、犯罪构成要件适用、法律滞后性等方面仍存在诸多困境。在分析人工智能滥用的主要形式及现行刑法规制现状的基础上，探讨人工智能滥用所带来的刑法适用难题，并提出未来刑法在完善罪名设定、强化跨部门协同治理、推动国际合作、利用技术手段加强监管等方面的优化路径，以期构建更加完善的人工智能滥用刑法规制体系，确保人工智能技术的安全、合规应用。
