Research Report on the Current Status and Issues of Juvenile Community Correction in Beijing

Although theCommunity Correction Lawhas preliminarily established a framework for the juvenile community correction system, critical questions remain unresolved: Can the so-called “dedicated chapter” legislative approach—comprising only seven provisions—adequately address the systematic needs of juvenile community correction? In what ways, to what extent, in what sense, and in what contexts should juvenile community correction be differentiated from adult community correction? How can institutional refinement and systematization respond to the individualized demands of juvenile community correction? Furthermore, how can the unique institutional designs for juvenile community correction be concretely implemented in practice? These issues urgently require systematic exploration and resolution. As the hope of the nation and the future of society, the governance and rehabilitation of juvenile delinquency represent an inescapable responsibility for modern rule-of-law states. Consequently, in-depth and systematic research on juvenile community correction—a critical component of the broader community correction system—is essential. Guided by this imperative, this paper thoroughly examines the institutional framework for juvenile community correction established under theCommunity Correction Law. By integrating diverse methodologies such as literature review, interdisciplinary analysis, comparative studies, field research, and case studies, it identifies and analyzes the practical challenges and underlying constraints affecting the effective implementation of juvenile community correction in Beijing. Finally, the paper proposes multidimensional pathways and measures to systematically improve the juvenile community correction system in Beijing.

虽然《社区矫正法》框架性地初步确立了未成年人社区矫正制度，但这种仅仅只有七个条文的所谓专章立法方式是否对未成年人社区矫正的体系化需求能够予以满足？未成年人社区矫正要在何种方式、何种程度、何种意义及其何种场域与成年人社区矫正进行区分？如何通过制度的细微化和体系化来回应未成年人社区矫正的个性化要求？又如何在社区矫正实践中具体落实未成年人社区矫正的特殊制度设计？这些问题仍然亟待系统探索与求解。作为国家希望和民族未来的未成年人，对其犯罪问题的治理和矫正是现代法治国家不可回避之责任，而作为社区矫正制度重要组成部分的未成年人社区矫正制度，对其深入系统地研究也因此显得极有必要。正是基于此种考量，本文在充分阐释《社区矫正法》所确立的未成年人社区矫正制度架构的基础上，通过综合运用文献研究、学科交叉、比较分析、实地调研、案例研究等多种研究方法交叉印证，分析和求证社区矫正实践中影响未成年人社区矫正制度在地方有效运行的问题及其背后的深层制约因素，进而从多个纬度提出体系化完善北京市未成年人社区矫正制度的具体路径与措施。
