기후변화는 이미 호주에 심각한 영향을 미치고 있다. 그럼에도 호주는 여전히 화석연료의 주요 수출국 이며 1인당 온실가스 배출량도 세계 최고 수준이다. 이러한 상황인 만큼, 호주에서는 많은 기후소송이 제기되어 왔다. 그러나 일반적으로 기후소송은 승소하기 어려웠고, 기후변화의 미래 영향에 중점을 둔 경우 특히 더 어려웠다. 본고에서는 호주에서의 기후소송 양상을 살펴본다. 호주의 헌법･법률 체계와 주 요 최근 사건을 살펴본 후 호주 법체계 내에서 세대 간 기후 정의를 실현할 수 있을지 평가한다. 다른 관할에서의 주요 동향은 향후 방향성을 제시할 수 있으며, 본고는 이러한 맥락에서 작성되었다.
Climate change is already affecting Australia in profound ways. Despite this, Australia remains a major exporter of fossil fuels and its emissions per capita are among the highest in the world. Therefore, it is unsurprising that Australia has had a large volume of climate litigation. However, climate cases have typically struggled to succeed, especially where they focus on the future impacts of climate change. This paper offers an analysis of the climate litigation landscape in Australia. After describing the constitutional and legal framework in Australia and notable recent cases, it evaluates the potential of Australian law to deliver intergenerational climate justice. This analysis is situated within the influential developments in other jurisdictions which might indicate possible future directions.
