Comparative Study on the DMCC Act in the UK and Digital Trade in the Korea·UK FTA

Purpose - This study aims to explore the balance between fairness in the digital market and free trade by analyzing the interaction between the UK’s DMCC Act and the digital trade norms of the Korea-UK FTA. Design/Methodology/Approach - This study conducted a comparative analysis of the DMCC and the Korea-UK FTA focusing on the regulatory objectives, legal structure, and enforcement mechanisms. Findings - The Digital Trade Chapter of the DMCC and the Korea-UK FTA presents new opportunities and challenges. Facilitating digital competition can be an opportunity for new market entry, but strict regulations can lead to additional costs and legal uncertainty. Research Implications - This study suggests that companies need to analyze the regulatory contents of the DMCC and respond strategically to maximize opportunities to enter the UK digital market. In addition, the two governments should actively utilize the Digital Trade Committee within the Korea-UK FTA to prevent excessive regulations, and derive practical support measures for Korean companies. Furthermore, cooperation such as joint development of data standards or easing the regulatory burden on small and medium-sized enterprises shows that it can promote digital innovation and strengthen the foundation for sustainable economic cooperation between the two countries.
