民族地区基层治理中的行政法治保障研究

Research on Administrative Legal Guarantee for Grassroots Governance in Ethnic Minority Areas

The governance of ethnic minority areas is not only a local practice of the national governance system but also a comprehensive carrier of national sovereignty, institutional advantages and the modernization process. Ethnic minority concentrated areas have characteristics such as cultural diversity, complex social structure, shortage of talents and resources, and the adaptability of administrative regulations. There are still many urgent problems to be solved in the formulation and implementation of laws in ethnic minority areas. This article explores the special requirements for administrative rule of law in the grassroots governance of ethnic minority areas, starting from different provinces and different ethnic groups, and analyzes the common difficulties faced by administrative rule of law in the grassroots governance of ethnic minority areas in combination with specific ethnic cultural backgrounds and ethnic customary laws. It further proposes paths to improve administrative rule of law in ethnic minority areas, aiming to build a grassroots governance model that is both ethnic-specific and in line with the spirit of the rule of law.

民族地区治理既是国家治理体系的地方性实践，也是国家主权、制度优势和现代化进程的综合性承载。少数民族聚居区域具有民族文化多样性、社会结构复杂性、人才和资源短缺，以及行政法规适应性等特点，民族地区的法律制定与实施仍存在诸多亟待解决的难题。本文探讨民族地区基层治理中对于行政法治的特殊要求，从不同省份和不同民族的角度出发，结合特定的民族文化背景和民族习惯法分析行政法治在民族地区基层治理中普遍面临的困境，进一步提出完善民族地区行政法治的路径，旨在构建一个既具有民族特色又符合法治精神的基层治理模式。
