사이버 수단을 이용한 해상봉쇄의 유효성 요건에 관한 고찰

Study on the Effectiveness Requirements of Maritime Blockades Employing Cyber Means

해상봉쇄는 적국의 전쟁 지속 능력을 마비시키는 효과적인 군사적 조치이지만, 국제법적 요건을 충족하지 않으면 불법 행위로 간주되며 중립국과의 외교적·군사적 충돌을 초래할 수 있다. 특히, 해상봉쇄의 유효성은 시행의 필수적인 전제조건으로, 그 핵심은 봉쇄 위반 선박을 실효적으로 통제할 수 있는 현장 전력의 충분성과 관련되어 있다. 최근 사이버전의 현실화로 사이버 봉쇄의 중요성이 부각되고 있지만, 그러한 비물리적 봉쇄 수단의 법적 유효성에 관한 연구는 아직 미흡한 실정이다. 본 논문은 해상봉쇄의 유효성 원칙을 중심으로 국제법적 요건의 변화를 살펴보고, 사이버 봉쇄의 유효성 요건을 정립하는 데 초점을 맞춘다. 또한, 사이버 역량이 포함된 다중 영역 해상봉쇄의 적용 가능성을 고려하여 전시 한반도 주변 해역에 적용할 수 있는 적절한 해상봉쇄 방안을 제시하고자 한다.

Maritime blockades are an effective military measure to incapacitate an enemy’s war-sustaining capabilities; however, if they fail to meet the requirements under international law, they are considered unlawful and may lead to diplomatic and military conflicts with neutral States. In particular, the effectiveness of a maritime blockade is a critical precondition for its implementation, with the key element being the sufficiency of on-site forces capable of effectively controlling ships violating the blockade. Recently, the importance of cyber capabilities has emerged, highlighting the need for cyber blockades; however, research on the legal effectiveness of intangible powers such as cyber blockades remains insufficient. This paper analyzes the changes in the principles of maritime blockade centered on the effectiveness and focuses on establishing the legal elements of the effectiveness for cyber blockades. Additionally, considering the potential application of multi-domain maritime blockades that include cyber capabilities, this paper aims to propose appropriate wartime blockade strategies that can be applied in the waters surrounding the Korean Peninsula.
