학교폭력예방법 상 학교폭력 대응 전문교육기관의 법적 형태와 설립방안

Legal form of specialized education institution for school violence response under the School Violence Prevention Act

이 연구에서는 학교폭력 피해학생 치유·회복 전문교육기관의 설치와 관련된 법적 쟁점을 분석하고 합리적인 설립방안을 제시하고자 하였다. 먼저, 그 법적 지위가 학교인지 비학교 형태인지 분석하였다. 다음으로 학교로 설치할 경우와 국립대 부설기관으로 설치하는 경우의 장단점을 분석하였다. 그리고 교육청 부지나 학교를 활용하는 방안과 국립대 유휴부지나 시설을 활용하는 방안을 비교하였다. 연구결과, 기관의 법적 지위는 학교와 비학교 형태 모두 가능한 것으로 해석하였고, 학교로 설치할 경우에는 대안학교로 설립하는 것이 가장 적절하고, 비학교형태일 경우 국립대 부설기관으로 설치하는 것이 적절하다고 보았다. 부지 확보 방안으로는 교육청의 폐교부지나 학교시설을 사용하면서 사용료를 지급하는 방안과 교육청 폐교를 국유지와 교환하는 방안을 제시하였고, 국립대 부설기관으로 설치하는 방안도 제시하였다.

This study analyzed the legal issues related to the establishment of specialized education institutions for healing and recovery of students who are victims of school violence and attempted to suggest reasonable establishment plans. First, we analyzed whether the legal status is a school or a non-school type. Next, we analyzed the pros and cons of establishing it as a school and as an affiliated institution of a national university. We compared the methods of utilizing the land of the Office of Education or a school and the methods of utilizing the idle land or facilities of a national university. As a result of the study, we interpreted that the legal status of the institution can be either a school or a non-school type, and if it is established as a school, it is most appropriate to establish it as an alternative school, and if it is established as a non-school type, it is most appropriate to establish it as an affiliated institution of a national university. As a method of securing the land, we suggested a method of paying a usage fee while using the closed school land or school facilities of the Office of Education and a method of exchanging the closed school of the Office of Education for national land, and we also suggested a method of establishing it as an affiliated institution of a national university.
