현직 장학사의 1인 시국선언에 대한 정치적 중립 및 품위유지 의무 위반 여부 고찰

A Study on the Violation of Political Neutrality and Duty to Maintain Dignity in a One-Person Declaration of the State of Affairs by a School Supervisor

본 연구는 최근 학계 및 교육현장에서 정치적 참여에 관한 관심이 높아지는 가운데 2024. 11. 8. 있었던 현직 장학사의 1인 시국선언에 대한 지방공무원의 정치적 중립 및 품위유지 의무와 관련된 의미를 살펴보고 이를 분석함으로써 교육의 정치적 중립성에 대한 방향성 확립에 기여하기 위해 실시되었다. 연구결과는 다음과 같다. 첫째, 장학사의 1인 시국선언에 대한 정치적 중립 의무 위반 여부를 살펴보기 위해 법적·행정적 검토와 함께 표현내용 및 방식, 직무관련성 등을 검토한 결과 1인 시국선언이 공직자인 장학사의 신분으로서 직무집행 내지 직무수행과 관련하여 이루어진 행위라고 보기 어렵고, 학생들의 수학권을 직접적으로 침해했다고 보기 어려운 점을 감안할 때 공무원 및 교육의 정치적 중립성을 위반하였다고 보기는 어렵다. 둘째, 현행 규정 및 판례상 품위유지 의무에 대해서는 직무 내외를 불문하고 있으므로 현직 장학사가 본인의 소속과 직을 드러내고 1인 시국선언이라는 형태로 정부 정책의 반대를 표명한 것은 자연인으로서의 의견 표명으로 보기는 어려운 점을 고려할 때 품위 유지의 의무 위반으로 볼 수 있으나, 이에 대한 제재는 비례의 원칙을 충분히 고려할 필요가 있으며, 공무원에 대한 품위유지의 의무 위반은 장기적으로 볼 때 직무 외의 부분은 제외하는 것이 타당하다. 이상의 논의를 바탕으로 공무원 및 교육의 정치적 중립성 관련 결론을 제시하였다.

This study was conducted to contribute to the establishment of a direction for political neutrality in education by examining and analyzing the implications of local public officials' obligation to maintain political neutrality and dignity in relation to the one-person national declaration by an school supervisor on November 8, 2024, in light of the increasing interest in political participation in academia and education. The findings of the study are as follows. First, in order to examine whether a school supervisor's solo declaration of the state of affairs violated the obligation of political neutrality, we examined the legal and administrative review, as well as the content and manner of expression and job-relatedness, and found that it is difficult to consider that the solo declaration of the state of affairs violated the political neutrality of local public servants, given that it is difficult to consider that the solo declaration was made in connection with the execution or performance of duties as a public servant. Second, since the current regulations and precedents do not distinguish between the duty to maintain dignity and off-duty behavior, a current school supervisor's disclosure of his affiliation and position, and his expression of opposition to government policy in the form of a one-person declaration, may be considered a violation of the duty to maintain dignity, considering that it is difficult to view it as an expression of opinion as a natural person, but the sanctions against him need to fully consider the principle of proportionality. Based on the above discussion, we present our conclusions regarding political neutrality in public servant and education.
