인공지능 기술 발전에 따른 최근 저작권 쟁점 분석 : 인공지능 모델 개발 및 서비스 제공 단계에서의 쟁점을 중심으로

Analysis of Recent Copyright Issues Arising from Advances in Artificial Intelligence Technology : Focusing on Issues in AI Model Development and Service Provision

챗GPT가 공개된 이래 현재까지 생성형 인공지능과 저작권에 관한 논의가 지속되고 있으나, 개별 국가 또는 지역적 차원에서의 대응방안이 논의되고 있을 뿐 국제적 수준에서의 합의된 규범 체계 또는 기술 표준 등이 마련되기까지는 상당한 시일이 소요될 것으로 보인다. 최근에 와서는 인공지능 서비스 제공 시 기존 인공지능 모델의 한계점 등을 보완하는 차원에서 파인 튜닝이나 RAG 등 부가적인 기술이 많이 활용되고 있으며, 인공지능 기술의 이용 양상 또한 더욱 다양해지고 있다. 따라서 나날이 발전하는 인공지능 서비스의 종류, 활용 방식 등이 함께 검토될 필요성이 있으며, 그 이용 양상에 따른 법적인 분석이 필수적으로 요구된다고 할 것이다. 이에 본고에서는 인공지능의 저작권 문제에 있어 중점적으로 살펴보아야 할 쟁점은 무엇이고 새롭게 발생하는 인공지능 기술에 따른 저작권 쟁점에는 또 어떠한 것이 있는지를, 관련 기술에 기반한 법적인 분석을 통해 살펴보고자 하였다. 인공지능 기술 발전으로 촉발된 저작권 문제에 대한 보다 명확한 해결을 위해서는 현행 저작권 체계 내에서의 법리적 분석과 함께 최근의 기술 변천 양상에 따른 새로운 해석론 또는 입법적 해결 방안에 대한 검토가 지속적으로 이루어져야만 할 것이며, 관련 산업 진흥과 창작자 권익 보호라는 두 가지 목표 사이에서 균형을 유지하기 위한 효과적이고 현실적인 정책 대안이 모색될 필요성이 있다.

Since the release of ChatGPT, discussions on generative AI and copyright have been ongoing. While individual countries and regions are formulating their own responses, it is expected that reaching an internationally agreed framework of norms or technical standards will require considerable time. Recently, additional technologies such as fine-tuning and Retrieval-Augmented Generation(RAG) have increasingly been employed to overcome limitations in existing AI models during AI service provision, thereby diversifying the utilization of AI technology. Consequently, there is a growing need to examine evolving AI services and their usage methods systematically, alongside conducting essential legal analyses tailored to specific applications. This paper identifies and analyzes key copyright issues associated with AI, particularly those emerging from recent technological advancements, using a legal framework grounded in relevant technologies. To effectively address copyright challenges posed by AI developments, it is essential to continuously undertake legal analyses within the existing copyright framework and explore new interpretative approaches or legislative solutions responsive to technological evolution. Additionally, it is imperative to develop effective and realistic policy measures to maintain a balance between promoting AI-related industries and safeguarding creators' rights.
