국제지적연맹의 창립 모형에 관한 연구

A Study on the Establishment Model for the International Cadastral Federation

본 연구의 목적은 국제기구와 국제지적연맹의 이론적 고찰을 실시하고, 국제기구의 운영 실태를 조사분석평가하며, 분석평가된 결과를 토대로 국제지적연맹의 창립 모형을 제시하는 것이었다. 연구 결과, 국제지적연맹 창립 모형의 설정 방향을 제시하면, 첫째, 설립 주체가 가장 쉽고, 빠르게국제기구화가 가능한 방향은 다자간 조약을 통한 국제기구 설립이 아닌, 비정부간국제기구로 창립하는방향이었다. 둘째, 설립 주체가 동일한 설립 목적을달성할 수있다면, 새로운비정부간국제기구를 설립하기보다는 기존의 민간단체를 확대개편하여 창립하는 방향이 바람직할 것으로 판단되었다. 셋째, 국제지적학회는 한국의 김상수 박사가 제안하여 설립된 단체이나, 한국지회가 유명무실하게 운영되고 있어, 이를 한국이 설립주체가되어비정부국제조직인국제지적연맹으로개편하여창립하는것이바람직한 방향으로 판단되었다. 다음으로, 국제지적연맹이 국제기구로서 창립하는 방법으로는 다자간 조약체결을 통한 창립방법, 기존 국제기구의 총회 결의에 의한 창립 방법, 비정부간국제기구로의 창립 방법, 국내법에 따라 기구 창립 후기존국제기구와 제휴 협정을 통한 창립 방법 등을검토하여 제시하였다.

The purpose of this study is to provide a theoretical examination of international organizations and the International Cadastral Federation, investigate, analyze, and evaluate the practical operations of international organizations, and, drawing on the evaluation results, present a model for establishing the International Cadastral Federation. The results of this study propose the following directions for formulating a model for establishing the International Cadastral Federation: First, the simplest and most expedient pathway to achieving international organizational status is to establish it as a non-governmental international organization rather than pursuing its formation as an international entity through multilateral treaties. Second, if the establishing body can accomplish the same objectives, it is deemed preferable to expand and restructure an existing private organization rather than establish a new non-governmental international organization. Third, although the International Cadastral Society was established based on a proposal by Dr. Sang-soo Kim of Korea, its Korean branch currently functions ineffectively. Thus, it is recommended that Korea assumes the leadership role in reorganizing the society into a non-governmental international organization under the name of the International Cadastral Federation. Next, this study explored and proposed several methods for establishing the International Cadastral Federation as an international organization. These include establishment through a multilateral treaty, establishment via a resolution of the general assembly of an existing international organization, establishment as a non-governmental international organization, and establishment under domestic law with subsequent formation of a partnership agreement with an existing international organization.
