토픽 모델링을 활용한 아동학대 판결문 분석: 양형 이유를 중심으로

A Topic Modeling Analysis of Sentencing Reasons in Child Abuse Court Rulings

최근 심각한 아동학대 사건이 사회적 이슈로 대두됨에 따라 아동학대에 대한 관심이 높아졌으며, 국가에서도 공적 개입을 확대하려는 움직임이 나타나고 있다. 본 연구에서는 보건복지부와 아동권리보장원이 선정한 2017-2019 아동학대 사건 판례집의 판결문을 활용하여 아동학대에 대한 법적 판단을 이해하고자 하였다. 아동학대 판례문의 판결문을 모두 수집하여 학대 행위의 주체에 따라 가정 내 아동학대, 기관 내 아동학대로 구분하였으며, 판결문 중 양형이유에 대하여 각각 유리한 정상과 불리한 정상을 추출하여 토픽모델링을 실시하였다. 이후 가정, 기관 내 아동학대의 유리한 정상과 불리한 정상의 토픽을 도출하고 아동학대의 특수성을 고려하여 이를 검토하였다.

In recent years, severe cases of child abuse have emerged as major social issues, drawing increased public attention and prompting the government to expand its efforts toward formal intervention. This study aims to explore the legal judgments surrounding child abuse by analyzing court rulings included in the 2017-2019 casebook on child abuse, published by the Ministry of Health and Welfare and the National Center for the Rights of the Child. The rulings were classified into domestic and institutional abuse based on the identity of the perpetrator. Sentencing reasons were extracted from each case and divided into mitigating and aggravating factors, which were then analyzed using topic modeling. The study identified topic clusters for both mitigating and aggravating factors in domestic and institutional child abuse cases and reviewed them in light of the unique characteristics of child abuse.
