독일 회복적 사법 실천모델에서의 사회복지사 역할

German TOA Program and the Role of Social Worker

본 연구는 사회복지사 중심으로 조정자로 활동하고 독일 TOA가 무엇인지, 독일 TOA에서 조정자의 역할과 조정자의 자격조건 및 조정자의 양성교육에 대해서 알아보고, 우리나라 형사조정제도에서 사회복지사 역할과 사회복지사의 유입 필요성에 대해 논하고자 한다. 본 연구를 보다 심층적으로 연구하기 위해서 연구자는 독일 TOA에 대한 정보를 얻기 위해 독일 TOA기관에서 조정자로서 일하고 있는 사회복지사와 e-mail로 인터뷰를 진행하였고, 다른 한편으로는 우리나라 형사조정제도에 대한 현 실태와 문제점을 알아보기 위해 대전지방검찰청을 직접 방문해서 형사조정 담당 검찰수사관과 인터뷰를 진행하였다. 형사조정에서 조정자는 조정의 성패를 좌우할 만큼 매우 중요하다. 조정자 역할은 갈등해결방안에서 당사자 간의 합의성립여부에 결정적인 영향을 미치기 때문에, 형사조정과정이 잘 진행되도록 책임감을 갖고 당사자들 상호 간의 건설적인 의사소통이 가능하게 하고 협의절차를 감독하는 점에서 사회복지사의 역할과 일맥상통한다고 볼 수 있다. 전문가인 사회복지사는 형사조정 조정자로서 사회복지의 철학과 가치관을 근간으로 사회복지실천기술을 활용하여 가해자와 피해자 간의 갈등해결방안을 찾도록 적극적인 자세로 형사조정을 진행할 수 있다. 따라서 사회복지사는 소정의 조정교육과정을 이수한 후 전문적인 사회복지실천기술을 활용하여 우리나라 형사사건 조정제도에서 전문적 조정자로 충분히 활동할 수 있다고 본다.

The purpose of this study is to suggest the role of social worker in criminal mediation program through an consideration on the role and activity of the mediator who executes the core role in German TOA process. The mediation organization in Germany carries out criminal mediation. In German TOA, social workers play almost a role as mediators. The mediator in criminal mediation demand a consistent standard basis to ensure a certain level of professionalism. The TOA-service office in Köln offers an opportunity to receive an educational training for the candidates, who want to work as mediator in criminal mediation. Social workers can support the conflicting parties to develop solutions in the mediation process. Social workers strengthen the autonomy of the parties, enable constructive communication between them and structure and supervise the mediation process. Social worker find a suitable and satisfying solution for the conflicting parties. Social workers are ready, trained and professional for conflicting parties in criminal mediation. Social workers can work as mediators in criminal mediation with practice knowledge and social work practice skills.
