The judicial application challenges of corporate bribery primarily manifest in two areas: the standards for conviction and the scope of sentencing. The former requires consideration of rules for identifying the entity, the separation of corporate and individual intent, and the derivation of improper benefits. The latter should focus on the application of leniency factors such as voluntary surrender, meritorious service, and special mitigating circumstances. This paper, through the analysis of existing judicial practices, refines the judicial determination rules and sentencing reference indicators for corporate bribery, aiming to provide more operational guidance for the judicial application of corporate bribery and promote the standardization and fairness of judicial practice.

单位行贿罪的司法适用困境主要表现在定罪标准与量刑幅度两个方面,前者需要考虑主体识别规则、单位意志与个人意志的分割以及不正当利益归属的推导路径;后者则应关注自首、立功以及特殊从宽情节的适用。本文通过对现有司法实践的分析,通过细化单位行贿罪的司法认定规则与量刑参考指标,以期为单位行贿罪的司法适用提供更具操作性的指导,推动司法实践的规范化与公正性。
