법적 정의와 법적 안정성 충돌의 해결방안 - 국가불법 청산의 경우를 중심으로

Resolving the conflict between legal justice and legal stability : Focusing on the case of state illegality liquidation

법적 정의와 법적 안정성은 법치국가의 주요한 구성원리이다. 그런데 국가불법을 청산하는 과정에서 법적 정의와 법적 안정성이 충돌하는 일이 발생한다. 이를테면 국가적 불법행위가 있었고 불법행위의 결과 이에 터 잡아 새로운 재산권 및 사적 권리관계가 설정되었을 경우에, 법적 정의의 관점에서 원상회복을 명령하면 법적 안정성이 파괴되고, 그렇다고 후행권리자의 법적 안정성만 보호했을 경우에는 원권리자의 법적 정의가 침해되는 딜레마가 발생한다. 물론 외견상으로 법적 정의와 법적 안정성이 충돌하는 것처럼 보이는 모든 문제가 진정한 의미에서 충돌이라고 할 수는 없다. 하지만 과거사청산의 사례에서 피해자(원권리자)와 새롭게 형성된 권리자(후행권리자) 사이에 분명히 법적 정의와 법적 안정성 문제로 갈등이 발생하는 경우는 분명히 존재한다. 단순히 침해된 원권리의 원상회복이라는 법적 정의만을 우선시하거나 아니면 후행권리의 존속이라는 법적 안정성만을 우선시해서는 첨예하게 대립하는 원권리자와 후행권리자 사이의 긴장과 갈등을 해결하기에 곤란하다. 본 논문은 국가불법이라는 과거사청산 영역에서 법적 정의와 법적 안정성이 충돌하는 경우, 어떻게 하면 이 문제를 해결할 수 있을지 그 해결기준을 법치국가적인 관점에서 검토하면서 인간의 존엄성과 자유와 평등이 어떻게 이러한 충돌의 해결기준으로서 작용할 수 있는지를 확인한다. 더불어 원권리자와 후행권리자의 갈등의 원인을 제공한 국가불법 발생과 그로 인해 새롭게 형성된 권리관계에 원권리자와 후행권리자의 기여와 귀책사유 여부, 모두에게 책임을 돌릴 수 없는 사유가 있는지, 국가불법 청산을 유보할 필요가 있는지 등도 해결기준으로 함께 살피고 있다.

Legal justice and legal stability are key components of the rule of law. However, legal justice and legal stability may conflict in the process of liquidating state illegalities. For example, if there has been a state illegality and new rights relationships have arisen as a result of the state illegality, there is a dilemma that restitution for the sake of legal justice for the original rights holder destroys legal stability, but if only the legal stability of the new rights holder is prioritized, the legal justice of the original rights holder is violated. Of course, not every issue that on the surface appears to conflict with legal justice and legal stability is a conflict in the true sense of the word. However, there are certainly cases where conflicts between the original and new rights holders arise over legal justice and legal stability in the process of liquidating state illegality. This conflict makes it difficult to resolve the tensions and conflicts between original and new rights holders by simply prioritizing legal justice in terms of restitution or legal stability in terms of the existence of new rights. This paper examines how to resolve the conflict between legal justice and legal stability in the area of state illegality liquidation from the perspective of the rule of law. It analyzes how human dignity, freedom and equality can serve as criteria for resolving such conflicts. It also considers whether the original and new rights holders contributed to or caused the occurrence of the state illegality and the new rights relationship, whether there are circumstances that make it difficult to hold anyone accountable, and whether there are cases in which a decision to liquidate the state illegality should be deferred.
