집단민원현장 경비원의 직무범위: 지역축제 행사장을 중심으로

집단민원현장으로서의 지역축제 행사장의 경우 사적자치영역이면서 다중의 시민들이 참여하는 장소적 특성으로 인해 여기에 배치되는 경비원의 직무와 한계설정은 면밀히 이루어질 필요성이 제기된다. 이에 따라 본 연구는 집단민원현장으로서 지역축제 행사장에서의 경비원의 직무와 한계에 대한 법적 해석을 통해 「경비업법」에 저촉되지 않는 범위 내에서 경비원이 수행할 수 있는 직무범위를 규명하고자 하였으며, 이를 구체적으로 살펴보면 다음과 같다. 경비원의 직무 근거는 시설주의 관리권이라 할 수 있으며, 지역축제 행사장으로의 차량 및 사람의 통행과 출입에 있어서 행사 목적과 원활한 행사진행을 위해 행사주체의 점유권을 경비원이 대신 행사하게 된다. 그리고 지역축제 행사장 경비원은 어떠한 경우라도 위력을 과시할 수 없으나 점유 방해에 대한 자력구제로서의 방위행위와 정당방위 내지 정당행위의 일환으로 이루어진 소극적 저항행위 또는 저항수단으로서의 유형력 행사 등 경비업무의 범위를 벗어나지 않는 범위 내에서의 물리력 행사는 허용된다. 또한 행사장 내에서의 도난 등 범죄예방 활동과 더불어 혼잡 등 위험발생의 방지를 위한 민원안내 및 목전에 위험이 임박한 매우 긴급한 경우 안전조치를 취할 수 있다. 이와 더불어 신변보호업무를 수행하는 경비원은 행사주체 측 임원이나 지방자치단체의 주요 인사 또는 무대 공연 출연자 등에 대한 생명과 신체에 가해지는 위해를 방지 또는 제거하기 위하여 신변보호대상자의 업무 수행에 지장을 주지 않는 범위 내에서 지근거리에 위치하거나 이동함과 동시에 우발상황 발생 시 방호 대피를 우선으로 수행하여야 한다.

In the case of local festival venues as sites of collective civic protest, the characteristics of the location as a privately governed area where multiple citizens participate raise the need for careful determination of the duties and limits of security guards deployed there. Therefore, this study seeks to clarify the scope of duties that security guards can perform without violating the Security Business Act through a legal interpretation of the duties and limitations of security guards at local festival venues as collective civil petition sites, and the specifics of this are as follows: The basis of the security guard's duties can be said to be facility-based management rights, and the security guard exercises the right of occupation on behalf of the event host in order to ensure the smooth running of the event and the passage and entry and exit of vehicles and people to and from the local festival venue. Furthermore, security guards at local festival venues are not permitted to use force under any circumstances, but are permitted to use physical force within the scope of their security duties, such as in defensive acts as a form of redress against interference with occupation, passive resistance as part of political party defense or political party activities, or as a means of resistance. They can also carry out crime prevention activities such as theft within the event venue, provide complaint notification to prevent dangers such as crowding, and take safety measures in emergency cases where danger is imminent. In addition, security guards who provide personal protection services must be stationed or move within close proximity to those who are being protected in order to prevent or remove threats to the life and body of event organizers, key personnel of local government organizations, or performers in stage performances, and must prioritize protective evacuation in the event of an emergency.
