A Review of Research on the Governance of Cross-Border Data Flow from the Perspective of Administrative Law

行政法视角下数据跨境流动治理研究综述

Amid the globalization of the digital economy, cross-border data flow governance is critical to national security and economic development, with administrative law-based institutional building vital for regulation and balancing security and development. Using a systematic literature review, this study analyzes Chinese core journals from three dimensions-administrative supervision system construction, procedural connection, and rights protection-to sort out relevant research. Existing studies feature diverse perspectives but insufficient systematicness, rich methods but weak theoretical innovation, underdeveloped technology integration, and scarce empirical research. It proposes constructing a whole-chain governance framework, promoting localized theoretical innovation, deepening technology-law integration, and strengthening empirical research, offering theoretical and practical support for improving China’s administrative supervision system for cross-border data flow.

数字经济全球化背景下，数据跨境流动治理关乎国家安全与经济发展，行政法视角下的制度构建对规范数据跨境流动、平衡安全与发展至关重要。采用系统性文献综述研究方法，对我国核心期刊论文从行政监管的制度构建、程序衔接、权利保障三大维度展开剖析，系统梳理行政法视域下我国数据跨境流动治理研究成果。现有研究呈现视角多元但系统性不足、方法丰富却理论创新薄弱、技术融合待深化、实证研究匮乏等特征。提出构建全链条治理框架、推进本土化理论创新、深化技术法律融合、强化实证研究等方向，为完善我国数据跨境流动行政监管体系提供理论支撑与实践路径。
