주택임대차분쟁 조정제도에서의 인공지능(AI) 활용방안

Artificial Intelligence(AI) Utilization Strategies for the Housing Lease Dispute Mediation System

주택임대차를 둘러싼 당사자 간의 분쟁을 소송 외의 방법으로 신속하고 효율적으로 해결하기 위해 2016년부터 주택임대차분쟁 조정제도를 도입·운영하였으나, 조정제도의 홍보 미흡, 당사자의 자발적 참여 저조, 절차적 한계 등으로 최근 몇 년간 조정성립률이 25%에도 미치지 못하고 있다. 이러한 한계를 보완할 방안으로 최근 온라인 분쟁해결(ODR)과 대체적 분쟁해결(ADR)에서 활발히 논의되고 있으며, 급격히 발전 중인 인공지능(AI)에 주목한다. 본 연구는 해당 제도의 현황과 한계를 분석하고, 국내외 인공지능(AI)활용 사례 등을 검토하여, 주택임대차분쟁 조정제도에서의 인공지능(AI) 기반 활용방안을 제시한다. 주요 방안으로 ⅰ) AI 챗봇을 통한 홍보 및 초기 상담, ⅱ) 빅데이터 분석을 통한 유사 분쟁사례 제공 및 합리적인 조정안 추천, ⅲ) AI 분쟁조정 시스템 구축을 통한 정보 제공 강화 및 피드백 향상이 있다. 이러한 인공지능(AI)의 활용은 조정절차의 신속성과 효율성을 높이고 조정제도의 신뢰도를 제고하여 궁극적으로 주택임대차분쟁의 예방과 사회적 비용 절감에 기여할 것으로 예상된다. 다만 활용 시 인공지능(AI)의 한계로 지적되는 개인정보 보호, 알고리즘 편향, AI 할루시네이션 등 법적·규범적 문제해결에 대한 후속 연구도 병행할 필요가 있다.

Since 2016, Korea’s Housing-Lease Dispute Mediation System has sought to resolve landlord-tenant conflicts swiftly and inexpensively outside the courts. Yet, because of limited publicity, low voluntary participation and procedural constraints, recent settlement rates remain below 25 percent. As a remedy, this study focuses on the fast-advancing field of artificial intelligence (AI), already widely discussed in online and alternative dispute-resolution (ODR/ADR) settings. After analysing the system’s current operation and weaknesses and surveying domestic and foreign AI-ADR cases, the study proposes three AI-driven improvements: (i) deployment of conversational-AI chatbots for public outreach and initial counselling; (ii) big-data analytics to supply parties with comparable case patterns and to recommend reasonable settlement options; and (iii) construction of an integrated AI mediation platform that enhances information provision and systematic feedback. These measures are expected to accelerate proceedings, raise procedural efficiency and restore confidence in the mediation scheme, thereby preventing future disputes and reducing broader social costs. Nevertheless, further research is required to manage legal and normative challenges—including data-privacy protection, algorithmic bias and AI hallucination—before full-scale implementation can be realised.
