≪반계수록≫에 보이는 재산권 보호 요소

≪Bangyesurok(磻溪隨錄)≫ and Private Property Right

≪반계수록≫ 연구는 그 동안 그 내용 중에 소개된 토지 제도가 고대의 정전법을 중시한 것에 초점을 맞추어 적극적인 재분배 정책을 주장했다거나 복고적인 정책을 제안했다는 등의 관점이 주로 부각되곤 했다. 그런데 ≪반계수록≫은 방대한 분량에서 다양한 관점의 개혁을 제안하고 있는 책이므로 그 내용 중에는 그간의 연구에서 비교적 덜 다루어진 사유 재산권의 보호를 긍정하는 내용도 상당한 양으로 나타나 있다. 우선 토지 제도에대해서는 정전법의 공동 경작 조항을 삭제하여 재산권의 처분권, 사용권, 수익권 중 사용권과 수익권을 충실히 보장하고자 했다. 이를 통해 처분권을 제한 해 공적 원리를 강조하는 가운데에도 재산권 보호를 통한 경제적 효율의 달성을 도모하였다. 아울러 결부법 대신 경묘법의 실시를 주장하여 토지의 사용권, 수익권에 대해 그 권리를 명확히 문서화하여 재산권 보호를 강화하고자 했다. 또 ≪반계수록≫은 역점, 참점 등의 가게를 활성화시켜 상업을 증진시키는 과정에서 재산권을 보호하여 거래를 증진시키고자 했으며 이를 대동법에 대한 긍정과 함께 서술하면서 17세기 이후 상품화폐경제의 발달에 부합하는 시각을 드러냈다. 동시에 노비 제도를 타파할 것을 주장하면서 노비 제도가 사유재산권을 보장하지 않으므로 경제적으로 비효율적임을 밝혀 놓기도 했다. 이러한 내용들은 유형원이부국강병을 목표로 현실적인 정책을 제안하기 위해 ≪반계수록≫에서 재산권 보호를 일정한 수준으로 강조하여 입체적이고 복합적인 다양한 방향의 논의를 다루었음을 보여 준다.

Modern studies on <Bangyesurok(磻溪隨錄)> have often focused on its emphasis on ancient Jeongjeonbeop(井田法), which has been understood as negative opinion to private property right in general. However, <Bangyesurok> is a book covering different area of many social problems from various points of views, which include the plans to improve private property right of individual. First of all, it suggests Jeongjeonbeop without joint cultivation. In this way, it supports, at least, “ius utendi” and “ius fruendi” of proprerty right, which can derive economic efficiency as well as social values from restriction of “ius abutendi”. And <Bangyesurok> supports Gyeongmyobeop(頃畝法), rather than Gyeolbubeop(結負法), which leads clear exclusion boundary of right to land and its clearer documentization. In addition, the book also suggests implementation of more buildings for commerce, such as Yeogjeom(驛店) and Chamjeom (站店), which lead more trades with improved private property right, based on positive opinion on Daedongbeop(大同法) representing economic development from 17th century. It also strongly opposes slavery, insisting that a slave has incomplete property right that results economic inefficiency. Therefore, the works from the scholars of late Chosun Dynasty, such as <Bangeysurok>, should be interpreted in more complex frame of analysis.
