金融企业数据跨境流动中数据分类分级问题研究

Research on Data Classification and Grading in Cross-Border Data Flow of Financial Enterprises

Against the backdrop of the accelerating global cross-border data flow and the interweaving of financial security risks, this paper analyzes and compares the relevant theories and practices in the field of cross-border data flow at home and abroad, and identifies the differences in legal regulations on data classification and grading in cross-border data flow among different countries and regions. At present, China is faced with such problems as inconsistent domestic and foreign standards due to different legislative frameworks and regulatory paradigms, lack of dynamic classification and grading mechanisms resulting from reliance on traditional static thresholds and lagging policy implementation, insufficient orientation of the financial data factor market due to imperfect market trading mechanisms and few participating subjects, and insufficient synergy of laws and regulations due to scattered regulations and fragmented standards. In order to better adapt to the changes and development of international rules and cope with the opportunities and challenges brought by global data flow, it is necessary to establish an internationally recognized standard system, construct a dynamic adjustment mechanism, promote the marketization of financial data factors, and strengthen legal synergy. By building a more scientific and reasonable data classification and grading mechanism, the healthy development of the financial market can be promoted.

在全球数据跨境流动加速与金融安全风险交织的背景下，本文通过分析与对比当前国内外数据跨境流动领域的相关理论与实践，得到不同国家和地区在数据跨境流动中数据分类分级方面的法律规制差异。目前我国面临立法框架与监管范式不同的国内外标准不统一、传统静态阈值依赖与政策落地滞后的动态化分类分级机制缺乏、市场交易机制不完善与参与主体较少等金融数据要素市场导向不足以及法规分散性与标准碎片化等法律法规协同性不足等问题。为更好适应国际规则的变化与发展，应对全球数据流动带来的机遇与挑战，应当建立国际互认的标准体系、构建动态调整机制、推进金融数据要素市场化和加强法律协同。通过构建更加科学合理的数据分类分级机制，促进金融市场健康发展。
