The application of AI has brought technological innovation to legal practice, while also impacting traditional statutory reasoning models. Due to the diversity and ambiguity of legal norms, the complexity of legal relationships, the controversial nature of legal interpretation and application, as well as the limitations and uncertainties inherent in advanced computer technology and algorithms, all these factors can lead to deviations or errors in the reasoning results of computer modeling and statutory interpretation. Through exploring how to run standardized versions on computers, the use of predicate logic, and whether the standardization of statutory law can be computerized, it is found that computer modeling of statutory law reasoning is difficult to meet the complexity and argumentation requirements of statutory law interpretation. However, existing digital technology is fully capable of designing a modeling of statutory law reasoning for market entities to apply the law. At the same time, the participation and supervision of human experts are also needed to jointly address issues involving computer modeling and deductive reasoning.
人工智能的应用为法律实践带来了技术革新,同时也对传统制定法推理模型带来冲击。由于法律规范的多样性与模糊性、法律关系的复杂性、法律解释与适用的争议性等原因,以及先进计算机技术和算法存在一定的局限性和不确定性,都会导致计算机建模制定法推理结果的偏差或错误。通过在计算机上如何运行规范化版本、谓词逻辑使用、制定法标准化是否可以计算机化等内容进行探讨,发现计算机建模制定法推理难以满足制定法解释的复杂性和论证的需求,但是现有数字技术完全能够为市场主体设计一个建模制定法推理来适用法律。同时,也需要人类专家的参与和监督,共同解决涉及计算机建模制定法推理的问题。
