독일 사례를 통한 고준위방사성폐기물 부지평가의 법적 기준 적용과 지질자료 활용 고찰

A Case Study of Legal Criteria Implementation for High-level Radioactive Waste Disposal Site Evaluation: Insights into Geological Data Utilization in Germany

본 연구는 독일의 부지선정법(StandAG)에 따라 시행된 고준위방사성폐기물 처분 부지평가 절차를 분석하고, 각 규제 기준(배제 기준, 최소 요건, 지구과학적 가중치 기준)이 실제로 어떻게 적용되었는지를 검토하였다. 특히 사업자인 BGE가 제출한 중간 보고서를 바탕으로, 해당 기준들이 어떤 지질·수리지질학적 지표와 데이터셋을 통해 평가되었는지 구체적으로 분석하였다. 분석 결과, 독일은 지질자료법(GeoDG)를 통해 공공기관의 지질자료 제공을 법적으로 의무화하고 있으며, 부족한 실측 자료에 대해서는 문헌 기반 참조 데이터셋을 활용하여 평가의 일관성과 과학성을 확보하였다. 이처럼 법률, 시행령, 데이터 체계가 유기적으로 연계된 구조는 국내 부지평가 제도 설계에 시사점을 제공한다. 특히, 국내에서도 현 시점에서의 자료 확보와 검증의 한계를 고려할 때, 참조 데이터셋 구축과 자료 제공 의무화, 불확실성의 제도적 통제 장치 마련이 필요하다. 본 연구는 독일 사례를 통해 기술 기준과 법적 장치를 결합한 평가 시스템의 작동 구조를 실증적으로 제시하고, 국내 제도 정비 방향을 제안하고자 한다.

This study analyzes Germany’s high-level radioactive waste site evaluation framework under the Site Selection Act (StandAG), focusing on how the legal criteria—exclusion, minimum requirements, and geoscientific weighting—are applied in practice. Using BGE’s interim report as a primary source, the research examines the specific geological and hydrogeological indicators and datasets employed during each stage of site evaluation. Germany’s approach, supported by the Geologiedatengesetz (GeolDG), legally mandates the provision of geoscientific data by public institutions and compensates for missing measurements using literature-based reference datasets. This integrated system of law, regulatory procedures, and data management offers meaningful implications for developing similar frameworks in Korea. Given Korea’s limited deep geological data, the study highlights the need to institutionalize reference datasets, mandate data provision, and introduce legal mechanisms to manage uncertainty. Ultimately, the German case illustrates a robust regulatory model where technical standards and legal instruments interact to ensure transparent, science-based site selection.
