기후 위기 대응을 위한 산업 전환의 경제적 충격 완화와 고용 안정성 확보에 관한 법제 개선 방안 연구 - ‘정의로운 전환’의 법적 구현을 중심으로

A Study on Legislative Improvement Measures for Mitigating Economic Impacts and Ensuring Employment Stability in Industrial Transition for Climate Change Response : Focusing on the Legal Implementation of Just Transition

본 연구는 전 지구적 기후 위기 대응과 탄소중립 사회로의 전환 과정에서 필연적으로 발생하는 산업 구조 재편이 야기하는 경제적 충격과 고용 불안정 문제를 재난법학적 관점에서 심층적으로 진단하고, 이에 대한 법제도적 개선 방안을 모색하는 것을 목적으로 한다. 기후변화는 단순한 환경 문제를 넘어 산업과 경제, 그리고 사회 구성원의 삶에 막대한 영향을 미치는 포괄적인 ‘사회경제적 재난’의 성격을 가진다. 특히, 기존 화석연료 기반 산업의 쇠퇴와 신산업으로의 전환 과정에서 발생하는 대규모 실업, 지역 경제 침체 등의 문제들은 ‘정의로운 전환(Just Transition)’의 원칙에 따라 해결되어야 할 중요한 과제이다. 연구는 먼저 국내외 산업 전환 동향과 이로 인해 발생하는 경제적, 고용 측면의 구체적인 ‘재난’ 양상을 정의로운 전환 개념과 재난법학적 관점에서 진단한다. 이어서 현재 국내의 산업 구조 조정, 고용 안정 및 직업 전환 지원 관련 법규들을 검토하고, 이들이 산업 전환이 초래하는 충격에 얼마나 효과적으로 대응하고 있는지 그 한계와 문제점을 파악한다. 또한, 독일의 석탄 산업 전환 사례와 유럽연합(EU)의 정의로운 전환 기금 등 해외 주요국의 성공적인 입법례와 정책 경험을 비교 분석하여 국내 법제개선에 필요한 시사점을 도출한다. 이 과정에서 각 법제도의 법적 및 정책적 함의를중심으로 논의를 전개한다. 이를 바탕으로, 본 연구는 ‘안전한 대한민국’ 구현을 목표로 산업 전환 과정의 경제적 충격을 완화하고 고용 안정성을 확보하기 위한 법제 개선의 개념적 틀과 주요 방향을 제안한다. 주요 제언으로는 ‘정의로운 전환 기본법(가칭)’ 제정을 통한 국가 차원의통합적 법적 기반 마련, 피해 산업 및 지역의 경제 활성화를 위한 조세 감면 및 특별지원 법률 강화, 고용보험 사각지대 해소와 실질적인 노동 전환 지원을 위한 법적 의무화 등이 포함된다. 궁극적으로 이 연구는 기후 위기 대응이 소수의 희생을 강요하는것이 아니라 모든 사회 구성원이 공정하고 안정적으로 미래를 준비할 수 있도록 법적· 제도적 안전망을 구축하는 데 기여하고자 한다.

This study aims to deeply diagnose the economic impacts and employment instability issues inevitably arising from the industrial restructuring process in response to the global climate crisis and the transition to a carbon-neutral society, from the perspective of disaster law, and to explore legislative and institutional improvement measures for these issues. Climate change transcends a mere environmental problem, embodying the nature of a comprehensive ‘socio-economic disaster’ that significantly affects industries, economies, and the lives of all members of society. In particular, challenges such as large-scale unemployment and regional economic stagnation, resulting from the decline of existing fossil fuel-based industries and the transition to new industries, are critical issues that must be resolved in accordance with the principle of ‘Just Transition.’ The study first diagnoses the concrete forms of ‘disaster’ from economic and employment perspectives, resulting from domestic and international industrial transition trends, through the lens of Just Transition concepts and disaster law. Subsequently, it reviews current domestic laws related to industrial restructuring, employment stability, and vocational transition support, identifying their limitations and problems in effectively responding to the impacts of industrial transition. Furthermore, it compares and analyzes successful legislative and policy experiences from major foreign countries, such as Germany's coal industry transition case and the European Union's Just Transition Fund, to derive implications for domestic legislative improvements. In this process, the discussion focuses on the legal and policy implications of each legislative system. Based on this, this study proposes a conceptual framework and key directions for legislative improvements aimed at mitigating the economic impacts and securing employment stability during the industrial transition process, with the goal of realizing a ‘safe Republic of Korea’. Key proposals include establishing a unified national legal framework through the enactment of a ‘Just Transition Basic Act (tentative name),’ strengthening laws for tax reduction and special support to revitalize affected industries and regions, and mandating the expansion of employment insurance coverage and practical support for labor transition. Ultimately, this research aims to contribute to building a legal and institutional safety net that ensures all members of society can prepare for the future fairly and stably, rather than demanding sacrifices from a few, in response to the climate crisis.
