본 연구는 디지털 기술의 급격한 발전과 온라인 플랫폼의 확산으로 심화되고 있는디지털 성범죄의 특수성을 분석하고, 현행 법제도의 한계와 개선 방안을 제시하는 것을목적으로 한다. 디지털 성범죄는 익명성, 초국경성, 복제·유포의 용이성, 영속성과 같은특징을 지니며, 이는 기존의 전통적 성범죄와 구별되는 요소이다. 그 결과, 현행 법제는피해자 보호와 범죄 억제에 있어 충분히 효과적으로 대응하지 못하고 있다. 이에 본 연구는 디지털 성범죄에 대한 법적 대응을 강화하기 위해 다음과 같은 개선방안을 제안한다. 첫째, 디지털 성범죄에 특화된 특별법 제정, 둘째, 플랫폼 운영자의 책임 강화, 셋째, 피해자 보호 및 지원 제도의 실질적 개선, 넷째, 첨단 기술 환경에 대응할 수 있는 수사 및증거 확보 역량의 강화, 다섯째, 국제 공조 체계의 제도화이다. 이러한 방안은 가해자 처벌, 피해자 보호, 범죄 예방을 조화시키는 통합적 법제도를 구축함으로써 기술 발전의 긍정적 효과를 극대화하고 그 부정적 결과를 최소화하는데 기여할 것이다.
This study aims to analyze the unique characteristics of digital sex crimes,which have been exacerbated by the rapid development of digital technologies andthe expansion of online platforms, as well as to examine the limitations of thecurrent legal framework and propose improvements. Digital sex crimes aredistinguished from traditional sexual offenses by features such as anonymity,transnationality, ease of reproduction and dissemination, and permanence. Consequently, existing legal measures have proven insufficient in effectively protecting victims and deterring such crimes. To enhance the legal response todigital sex crimes, the study proposes the following: enactment of a special lawdedicated to digital sex crimes, strengthening the accountability of platformoperators, substantial improvement of victim protection and support systems,reinforcement of investigative and evidentiary capabilities to address advancedtechnological environments, and institutionalization of international cooperationmechanisms. These measures aim to establish an integrated legal system thatharmonizes offender punishment, victim protection, and crime prevention, therebymaximizing the positive effects of technological progress while minimizing itsnegative consequences.
