부패는 국가의 신뢰를 잠식하고, 사회적 자본을 파괴하며, 경제 발전을 저해하는 가장 심각한 병폐 중 하나이다. 대한민국은 그동안 부패방지법, 청탁금지법 등 제도적 장치를 통해 부패와의 전쟁을 선포해왔다. 그러나 복잡한 현대 사회에서 부패의 양상은 더욱 지능화, 고도화되고 있으며, 인간의 직관과 제한된 자원에 의존하는 전통적인 감시 및 적발 시스템은 점차 한계에 부딪히고 있다. 이 시점에서 우리는 인공지능(AI)이라는 새로운 기술적 패러다임에 주목해야 한다. AI는 방대한 데이터를 분석하여 인간이 발견하기 어려운 미세한 이상 징후나 패턴을 포착하는 데 탁월한 능력을 가지고 있다. 따라서 AI가 단순한 기술적 도구를 넘어, 정부의 부패 방지 체계를 '사후 적발'에서 '사전 예방'으로, '표본 조사'에서 '전수 분석'으로 전환시키는 근본적인 동력이 될 수 있다는 점을 법학적 관점에서 논하고자 한다. 본 논문은 우선 먼저 AI가 부패 방지 시스템에 어떻게 적용될 수 있는지 구체적인 방안을 검토한 후 이러한 기술 도입이 야기할 수 있는 법적, 윤리적 문제를 고찰하고 부패방지를 위한 AI의 적절한 운영 방안에 대해 제시하고자 한다.

Corruption is one of the most serious diseases that weakens the trust of a country, destroys social capital, and hinders economic development. South Korea declared war on corruption through institutional arrangements such as the Anti-Corruption Act and the Anti-Graft Act. However, in a complex modern society, aspects of corruption are becoming more intelligent and advanced, and traditional surveillance and detection systems that rely on human intuition and limited resources are increasingly facing limitations. At this point, we need to pay attention to a new technological paradigm called artificial intelligence (AI). AI has a superior ability to detect microscopic anomalies or patterns that are difficult for humans to detect by analyzing vast amounts of data. Therefore, today I would like to discuss from the legal point of view that AI can be a fundamental driving force to shift the government's anti-corruption system from 'post-detection' to 'pre-prevention' and from 'sampling' to 'full analysis'. This paper first examines how AI can be applied to anti-corruption systems, then considers the legal and ethical problems that these technologies can cause, and presents appropriate operational plans for artificial intelligence (AI) for anti-corruption.
