An Analysis of Cyber Gambling Mediated by Online Games

본 연구는 합법적인 온라인게임 시스템을 매개로 이루어지는 신종 사이버도박, 즉 ‘게임매개도박’의 구조와 법적 규율 가능성을 분석하고 실효적 대응방안을 제시하는 것을 목적으로 한다. 게임매개도박은 게임 내 채팅·거래 시스템과 유튜브 등 스트리밍 플랫폼을 결합하여 별도의 불법 사이트 없이도 도박을 진행할 수 있는 구조를 가지며, 외형상 단순한 게임 활동으로 위장되어 단속이 어렵다. 형법과 특별법 적용 과정에서 규율의 중복과 공백이 동시에 나타나, 법집행의 일관성이 저하되고 규제 실효성이 낮아지는 문제가 확인되었다. 연구 결과, 첫째, 형사법적 규율의 정합성을 강화하여 신종 도박 행위에 대한 포괄적이고 일관된 법적 대응을 가능하게 해야 한다. 둘째, 사행행위 관련 특별법의 해석 및 적용범위를 명료화하여 합법 게임을 매개로 한 도박 행위에 대한 규제 공백을 해소해야 한다. 셋째, 플랫폼 사업자의 협력 의무를 강화하고 수사기관의 증거 확보 절차를 정비하여 단속 역량을 높여야 한다. 넷째, 게임매개도박의 특성을 반영한 통합적 규제 모델을 마련하여 예방과 단속을 병행하는 체계를 구축해야 한다. 이러한 방안은 신종 온라인 도박 범죄에 대한 대응력과 법집행의 예측 가능성을 제고하는 데 기여할 것이다.

This study aims to analyze the structure and legal regulation of a new form of cyber gambling—referred to as “game-mediated gambling”—which operates through legitimate online game systems, and to propose effective countermeasures. Game-mediated gambling combines in-game chat and trading systems with streaming platforms such as YouTube, enabling gambling activities without the use of separate illegal websites. This structure allows such activities to be disguised as ordinary gaming behavior, making enforcement difficult. The application of the Criminal Act and special laws reveals both overlaps and gaps in regulation, leading to diminished consistency in law enforcement and reduced regulatory effectiveness. The research findings suggest the following: First, the coherence of criminal law regulation should be strengthened to enable comprehensive and consistent legal responses to emerging gambling activities. Second, the interpretation and scope of application of special laws on speculative acts should be clarified to address regulatory gaps in gambling activities mediated by legitimate games. Third, the cooperation obligations of platform operators should be reinforced, and investigative procedures for securing evidence should be refined to enhance enforcement capabilities. Fourth, an integrated regulatory model reflecting the characteristics of game-mediated gambling should be developed to establish a system that combines prevention and enforcement. These measures are expected to enhance the capacity to respond to emerging forms of online gambling crimes and improve the predictability of law enforcement.
