국가기밀은 국가안전보장, 외교관계, 공공질서 등과 직결되는 핵심 정보이므로 외부 유출된다면 국가의 존립과 국민의 생명·재산에 중대한 위해를 초래할 수 있다. 특히 국제 정세의 불안정성과 기술경쟁의 심화 속에서 정보의 가치와 위험성이 부각되었고 국가기밀의 보호는 단순한 행정 문제를 넘어 국가안보의 본질적 요소로 떠오르고 있다. 그러나 현재 한국의 국가기밀 보호체계는 여러 한계를 내포하고 있다. 법령이 다원화되어 적용기관별로 분산되어 있고 기밀의 정의 및 등급 분류기준이 모호하며 보호 대상과 관리 체계가 일관성이 부족한 실정이다. 또한 기밀 누설에 대한 제재가 현실적 억지력을 갖기 어렵고 사이버 위협이나 기술유출과 같은 새로운 유형의 침해에 대응하기 위한 법적 기반도 미비한 상황이다. 이 연구는 첫째, 국가기밀의 개념과 특성을 재정립하고 둘째, 미국·영국·프랑스 등 주요 선진국의 기밀보호 제도를 비교 분석하여 공통된 특징과 차이점을 도출하였다. 셋째, 보안업무규정 및 관련 법률의 운영상 문제점을 진단하여 체계적이고 통합된 국가기밀 보호체계의 구축을 위한 법·제도 개선방안을 제시하였다. 이 연구는 향후, 국가기밀 보호체계를 법·제도적으로 정비하는데 실효성과 체계성을 확보하기 위한 기초자료로 활용되고 국가정보 보호와 안보체계 강화에 기여하고자 한다.

National secrets are key information directly related to national security, diplomatic relations, and public order. If such information is leaked externally, it could seriously endanger the survival of the nation and the lives and property of its people. Especially amid increasing instability in international affairs and intensifying technological competition, the value and risks of information have become more prominent. As a result, the protection of national secrets has emerged as a fundamental element of national security, rather than a mere administrative issue. However, the current system for protecting national secrets in Korea presents various limitations. The applicable laws are diverse and fragmented across institutions, and definitions and classification criteria for secrets lack clarity and consistency. The management system also suffers from a lack of uniformity. Moreover, sanctions for leaks often lack real deterrent power, and there is insufficient legal foundation to respond to new types of threats such as cyberattacks and technology leakage. This study, first, redefines the concept and characteristics of national secrets. Second, it conducts a comparative analysis of national secret protection systems in major advanced countries such as the United States, the United Kingdom, and France, identifying both common features and differences. Third, it diagnoses operational problems in the current Security Work Regulations and related laws, and presents legal and institutional improvement measures to establish a systematic and integrated national secrets protection framework. Going forward, this study aims to serve as foundational research for ensuring effectiveness and systematization in legislating a national secrets protection framework. It also intends to contribute to enhancing the protection of national intelligence and the overall national security system.
