대테러합동조사팀 역량 강화 방안에 대한 고찰

이 논문의 목적은 증가하는 테러 위협에 대응하기 위해 대테러합동조사팀의 주요 임무와 핵심 역량을 고찰하고, 미국 등 대테러 선진국의 사례를 분석하여 국내 현실에 부합하는 대테러합동조사팀의 역량 강화 방안을 제시하는 데 있다. 이를 위해 최근 테러 양상과 추이를 분석하고 특징을 도출하였다. 이를 바탕으로 대테러조사활동의 개념과 유형을 구분및 분석하였고, 대테러조사활동의 효과성을 향상을 위해서 법적 기반의 구축과 제도적 개선이 선행돼야 한다. 또한 법률적 공백을 방지하기 위한 지침서 마련과 현장조사 절차가 중요하며, 문서 열람, 시료 채취, 자료 제출 및 진술 요구 등 구체적인 조사 기법의 정립이 필요하다. 과학적 조사체계 구축을 통해 합동조사팀원의 역량을 강화하고, 실질적 지원이 가능하도록 기술적 부분을 보완해야 한다. “합동”이라는 명칭에 걸맞게 유관기관 간의 협업을 기반으로 정보 공유와 수집된 자료의 체계적 관리 방안이 보완될 필요가 있다. 결과적으로 다양한 테러 징후를 신속히 식별하고, 선제적 대응 및 발생 즉시의 규명과 대응 방향 제시가 가능한 대테러합동조사팀의 역할에 대한 재인식과 지속적인 역량 강화가 꾸준히 추진돼야 한다.

The purpose of this article is to examine the main tasks and core capabilities of the Joint Counter-Terrorism Investigation Team in response to the increasing threat of terrorism, analyze cases from advanced countries in counter-terrorism such as the United States, and suggest ways to strengthen the capabilities of the Joint Counter-Terrorism Investigation Team that are suitable for domestic reality. To this end, the recent patterns and trends of terrorism were analyzed, their characteristics were derived, and the concepts and types of counter-terrorism investigation activities were categorized and analyzed based on this. In addition, in order to increase the effectiveness of counter-terrorism investigation activities, the establishment of a legal foundation and institutional improvement should be preceded, and in particular, the importance of guidelines to prevent legal gaps and on-site investigations is emphasized. It is also necessary to establish specific investigation techniques such as document inspection, sample collection, data submission, and statement requests. The capabilities of the Joint Counter-Terrorism Team members should be strengthened through the establishment of a scientific investigation system, and the technical aspects should be supplemented to enable practical support. In line with the name of 'joint', information sharing based on collaboration between related organizations and systematic management of collected data are also important. In conclusion, it is necessary to re-recognize the role of the Joint Counter-Terrorism Investigation Team, which can quickly identify various signs of terrorism, respond preemptively, and suggest directions for investigation and response immediately after occurrence, and to continuously strengthen its capacity.
