공연 암표의 단속 및 처벌 실효성 제고를 위한 공연법 개정 연구

The Study on Amendment of Public Performance Act to Enhance the Effectiveness of Crackdown and Punishment of Scalping Tickets

현행 공연법이 시행된 2024년 3월 22일 이후에도 여전히 암표 거래는 성행하고, 온라인 암표 근절을 위한 제도적·현실적 실효성을 높이기 위한 관련 공연법 등 법 추가 개정의 요구가 지속되고, 단속 및 처벌에 대한 실효성 여부가 문제되고 있다. 그러나, 현행 공연법의 처벌 구성요건을 분석하면, 구성요건의 적용과 관련하여 단속 및 처벌에서 상당한 문제점을 발견할 수 있는데 암표 판매라는 1개의 행위로 처벌할 수 있는 것이 아니라, “매크로 등을 이용해서 부정구매하고”, “이러한 부정구매한 입장권등을 웃돈을 받고 부정판매”하는 2개의 행위가 연속한 행위에 대하여 처벌하는 구조로 법 조항이 설계되었다는 문제가 있다. 즉, 현행 공연법 조항에 따르면, 입장권등을 ‘매크로를 이용해서 부정구매한 자’와 ‘웃돈을 받고 부정판매한 자’가 각각 별도인 경우에는 그 중 1개의 행위에 대하여는 처벌할 수 없게 되는 한계가 있다. 이는 매크로를 통한 구매자와 이를 웃돈을 받고 판매하는 자가 분리되는 조직적인 형태에 관하여 압수수색 영장의 청구 및 발부에 있어서 문제가 발생하고, 두 행위가 시차를 두고 일어날 수 밖에 없다는 점을 고려하면 단속에 있어 심각한 문제점을 내포하고 있다. 또한 ‘웃돈을 받고 부정판매한 행위’를 단속한다고 하더라도 ‘매크로 이용을 통한 부정구입 행위’를 입증하기 어렵다는 문제가 있다. 이에 따라, 현행 공연법 개정 논의가 심화되는 한편 공연 암표단속에 관한 실효적인 정부의 대응에 필요성이 증가하고 있는 상황에서 본고는 공연법 개정 방향을 중심으로 암표 단속 및 처벌의 실효성 제고 방안을 제언하였다.

Despite the enforcement of the amended Public Performance Act on March 22, 2024, illegal ticket scalping remains pervasive in both online and offline domains. The study identifies critical limitations in the current legal framework, particularly in the penal provisions, which require a two-stage conduct— unauthorized acquisition via macro software and subsequent resale at inflated prices—to constitute a punishable offense. This design creates enforcement gaps where each act, if conducted by separate individuals or entities, cannot be sanctioned independently. It also poses challenges for law enforcement in obtaining warrants and proving the sequential linkage between the acts. Furthermore, even when inflated resale is detected, substantiating macrobased illicit acquisition remains difficult. In response to these issues, this study examines legislative trends and proposes amendments to the Public Performance Act to expand regulatory coverage, eliminate macro-usage prerequisites, and strengthen investigatory authority to enhance the effectiveness of crackdown and punishment on scalping practices.
