EncroChat은 텔레그램과 같은 암호통신망시스템인데, 유럽에서 네덜란드, 스페인, 영국, 독일, 이탈리아 등의 범죄조직원 등이 EncroChat이 설치된 암호휴대전화를 이용하여 마약거래 등의 범죄를 범해왔고, 독일은 프랑스가 온라인수색을 통해 이미 획득하여 소지·보관하고 있는 EncroChat 증거를 EU수사명령을 통해 제공받아 자국 마약범죄자들을 기소하였다. 재판에서는 독일이 프랑스로부터 제공받은 EncroChat 증거의 증거능력이 인정되는지가 문제되었는데, 관련 일련의 사건에서 독일 연방대법원, 독일 연방헌법재판소 그리고 EU 사법재판소는 그러한 EncroChat 증거의 증거능력이 인정된다고 판단하였다. 독일은 2024년에 대마초 관련 형사규제를 변경하면서 ‘적지 않은 양의 대마초 취득·거래’죄를 온라인수색의 대상범죄에서 제외하였는데, 2025. 1. 30. 자 독일 연방대법원 판결에서는 ‘적지 않은 양의 대마초 취득·거래’죄가 법개정에 의해 재판시점에는 온라인수색의 대상범죄에서 제외되었는바 프랑스로부터 제공받은 EncroChat 증거의 증거능력을 인정할 수 있는지가 문제되었다. 이 글은 독일의 기존 EncroChat 관련 판결 및 2025. 1. 30.자 독일 연방대법원 판결을 소개하고 우리 법에로의 시사점에 대해 검토한다.

EncroChat is a cryptographic communication network system such as Telegram. In Europe, criminal members of the Netherlands, Spain, the United Kingdom, Germany, and Italy have committed crimes such as drug trafficking using cryptographic mobile phones installed with EncroChat, and Germany prosecuted domestic drug offenders by receiving EncroChat evidence through an EU investigation order. In the trial, it was questioned whether the EncroChat evidence was admissible. In a series of related cases, the German Supreme Court, the German Federal Constitutional Court, and the Court of Justice of the European Union determined that such EncroChat evidence was admissible. Germany changed criminal regulations related to cannabis in 2024, excluding the crime of “not a small amount of cannabis acquisition and transaction” from the crimes subject to “Online Durchsuchung”. In the ruling of the German Supreme Court on January 30, 2025, it was questioned whether the EncroChat evidence was admissible in case of the crime of “not a small amount of cannabis acquisition and transaction”, which was excluded from the crime subject to “Online Durchsuchung”.
