It proposes constructing a new governance framework centered on the balanced allocation of “rights-responsibilities-benefits,” emphasizing institutional innovation through reshaping administrative agreements, improving legal regulatory systems, and establishing tiered authorization mechanisms. By resolving challenges in the market-oriented allocation of public data while ensuring security, this study provides a systematic solution to unleash the value of public data resources and drive high-quality development of the digital economy.

随着“数据二十条”将数据要素确立为新型生产要素，公共数据授权运营成为激活数据价值的关键路径。本文针对现行模式中存在的权属界定模糊、安全监管失衡、运营机制滞后等制度性短板，提出构建以“权-责-利”均衡配置为核心的新型治理框架，强调通过创新行政协议形态、完善法律规制体系、建立分级授权机制等制度创新路径，在保障数据安全前提下破解公共数据要素市场化配置难题，为释放公共数据资源价值、驱动数字经济高质量发展提供系统性解决方案。
