父母干预未成年人网络娱乐行为的家事法解决方案—以 101 个中国裁判文书网案例为例

A Family Law Solution to Parents’ Intervention in Minors’ Online Entertainment Behaviors: A Case Study of 101 Cases from the China Judgments Online Database

In the issue of improper use of online entertainment platforms by minors, most studies only focus on post-event judicial relief, neglecting the significance of parents’ pre-emptive intervention. By statistically analyzing and organizing 101 relevant cases obtained from the China Judgments Online, with the example of minors’ live-streaming tipping, this paper delves into the practical difficulties faced by parents during their intervention. On this basis, taking family law as the governance approach, it conducts a comprehensive analysis of the responsibilities that families should bear throughout the process, specifically covering the different forms of responsibility in the three key stages of pre-event prevention, in-event intervention, and post-event relief. Meanwhile, from the perspective of family law, platforms should take the initiative to act, actively reshape verification mechanisms and enhance transaction interception technologies. The state and society also need to work together, through effective legal publicity activities, to provide strong support for guardians to fulfill their guardianship duties. Ultimately, a closed-loop protection system for minors’ online rights and interests is formed, which includes “legal publicity - parental guardianship intervention - platform technical prevention - judicial and administrative protection - legal publicity”.

在未成年人网络娱乐的问题中，多数研究只针对事后司法救济展开讨论，忽视了父母事前干预行为的重要性。本研究通过对在中国裁判文书网上获取的以未成年人直播打赏为例的 101 个相关案例进行数据统计与整理，深入剖析父母干预时的现实困境。在此基础上，以家事法为治理思路，对家庭在整个过程中应承担的责任进行全过程分析，具体涵盖事前预防、事中干预以及事后救济三个阶段的不同责任形态。同时，在家事法视角下，平台主动作为，积极重塑核验机制与交易拦截技术，而国家与社会也需协同发力，通过有效的法治宣传，为监护人提供有力支持。最终，形成“法治宣传—父母监护干预—平台技术防控—司法行政护航—法治宣传”的闭环式未成年人网络权益保护体系。
