“新文科”背景下涉外法治人才培养体系创新与实施路径探析

Innovation and Implementation Paths of the Cultivation System for Foreign-related Rule of Law Talent under the Background of New Liberal Arts

This study, grounded in the national strategic demands of the New Liberal Arts initiative and the development of foreign-related rule of law, focuses on vocational undergraduate education as its core context. Through a review of policy documents, interviews with students and faculty, and the construction of a multi-theoretical framework, it systematically investigates the pathways for cultivating foreign-related legal talent. The research identifies several challenges within the current cultivation system, including a misalignment between training objectives and strategic needs, a disconnect between training models and the principles of New Liberal Arts, obstacles in the articulation mechanisms of vocational education, and insufficient localization of international experiences. Building on core theoretical supports such as interdisciplinary integration theory and competency-based theory, this paper clarifies the positioning of foreign-related legal talent in vocational undergraduate education as “technical-composite talents.” It proposes a core logic of “precise positioning-interdisciplinary curriculum-scenario-based practice-articulated cultivation.” The aim is to provide theoretical references and practical pathways for addressing the mismatch between talent supply and demand, improving the cultivation system for foreign-related legal talent in vocational undergraduate education, and ultimately contributing to high-level opening-up and the needs of global legal governance.

本研究立足新文科建设与国家涉外法治战略需求，以职业本科教育为核心场景，通过政策文献梳理、师生访谈调研与多理论框架建构，系统探究涉外法治人才培养路径。研究发现，当前培养体系存在培养定位与战略需求错位、培养模式与新文科理念割裂、职业教育贯通机制梗阻、国际经验本土化适配不足等多重困境。基于跨学科融合理论、能力本位理论等核心支撑，本文明确职业本科涉外法治人才“技术型复合人才”的定位，提出“精准定位-跨学科课程-场景化实践-贯通培养”的核心逻辑，为破解人才供需错配难题、完善职业本科涉外法治人才培养体系提供理论参考与实践路径，助力服务高水平对外开放与全球法治治理需求。
