관동대지진 직후 ‘치안유지령 ’ 시행을 둘러싼 정치적 역학 - 유언비어 안정기에 시행된 ‘유언비어 단속법'

Political Dynamics Surrounding Order concerning the Punishment for Peace Preservation after the Great Kanto Earthquake: The “Rumor Control Law” Implemented during the Period of Suppressed Rumors

본고는 1923년 9월 1일에 발생한 관동대지진 직후의 조선인 관련 유언비어의 확산과 당국의 치안유지 시책을 보다 입체적으로 이해하기 위한 노력의 일환으로 , 치안유지령(1923년 9월 7일 )의 의미를 재조명한다. 당시 대지진으로 인한 혼란 속에서 내각은 치안유지령을 공포･시행하였다. 선행연구에서는 이 치안유지령을 주로 치안유지법의 전사 (前史)로 논의하였으나, 그 시행 과정은 충분히 밝혀지지 않았다. 또한 치안유지령 입안에서 공포까지를 주도한 사법성의 역할은 지적되었으나, 치안유지령에 앞서 1922년 의회에 제출된 과격사회운동 단속법안이 내무성의 소극적인 태도로 폐안된 사실과 연계하여 사법성의 치안유지령 추진을 새롭게 이해할 여지가 있다. 본고는 치안유지령 조문을 치안당국의 여러 발표문과 비교 분석함으로써, 계엄 선포 상황이었기 때문에 비로서 치안유지령의 시행이 가능했다는 점을 밝히고, 당시 치안유지 주도권의 변화에 주목하여 치안유지령의 시행을 가능하게 한 주요한 계기가 가메이도 사건 (亀戸事件)이었음을 논하고자 한다.

This paper reexamines the significance of Order concerning the Punishment for Peace Preservation (1923 No. 403, Chianijirei), promulgated one week after the Great Kanto Earthquake on September 1, 1923, as part of an effort to more comprehensively understand the spread of rumors concerning Koreans and the authorities' security measures in its immediate aftermath. Amid the chaos triggered by the earthquake, the Cabinet promulgated and implemented the order. While prior studies have primarily discussed this order as a precursor to the Peace Preservation Law(Chianijihō), its implementation process remains underexplored. The Ministry of Justice's leading role from drafting to promulgation has been noted, yet its push for the order invites fresh interpretation when linked to draft bill to control radical social movements(the Kageki shakai undō torishimari hōan) of 1922, submitted to the Diet but shelved due to the Home Ministry's passive stance. Through comparative analysis of the order's provisions against various announcements by security authorities, this paper demonstrates that implementation was feasible only under martial law and argues that the Kameido Incident served as the key trigger—amid shifts in security leadership—that enabled the order's enforcement.
